KRS 205.170 is amended to read as follows: 3 (1) In the discharge of the duties imposed by this chapter, the secretary or his or her 4 duly authorized representative may administer oaths and affirmations, take 5 depositions, certify official acts, and issue subpoenas to compel the attendance of 6 witnesses and production of books, papers, correspondence, memoranda and other 7 records considered necessary and relevant as evidence in connection with the 8 administration of the cabinet. The subpoenas[Such subpoena] shall be served in the 9 same manner as a subpoena issued out of a Circuit Court. 10 (2) No person shall be excused from attending and testifying or from producing books, 11 papers, correspondence, memoranda or other records in response to the[such] 12 subpoena on the grounds that the evidence required of him or her may tend to 13 incriminate him or her or subject him or her to a penalty, or forfeiture. No person 14 shall be prosecuted or subjected to any suit, penalty, or forfeiture on account of any 15 transaction, matter, or thing concerning which the person or the person's[he or his] 16 agent or worker is compelled, after having claimed privilege against self-17 incrimination, to give evidence except that such witness so testifying shall not be 18 exempt from punishment for perjury. 19
