AN ACT relating to lobbying. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 12 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) For the purposes of this section: 5
(a) "Lobbyist" means a person who: 6
1. Promotes, advocates, or opposes the passage, modification, defeat, or 7
executive approval or veto of any legislation by direct communication 8
with any member of the General Assembly, the Governor, the 9
secretary of any program cabinet listed in KRS 12.250, or any staff 10
member of the officials listed in this subparagraph; or 11
2. Is engaged to influence executive agency decisions or to conduct 12
executive agency lobbying activity as one (1) of his or her main 13
purposes regarding a substantial issue, including associations, 14
coalitions, public interest entities formed for the purpose of promoting 15
or otherwise influencing executive agency decisions, and placement 16
agents and unregulated placement agents; and 17
(b) "Lobbyist" does not include an elected or appointed officer or employee of a 18
federal or state agency, state college, state university, or political subdivision 19
who attempts to influence or affect executive agency decisions in his or her 20
fiduciary capacity as a representative of his or her agency, college, 21
university, or political subdivision. 22
(2) No program cabinet, department, division, branch, section, organizational unit, 23
unit, office, or administrative body shall employ a lobbyist, as defined in 24
subsection (1)(a) of this section. 25
