AN ACT relating to programs of all-inclusive care for the elderly. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 216B IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section: 5
(a) "National Background Check Program" or "NBCP" means the enhanced 6
employment background check screening process used by health facilities 7
or services that are licensed under this chapter; 8
(b) "PACE" means programs of all-inclusive care for the elderly as provided in 9
42 U.S.C. sec. 1395eee; and 10
(c) "PACE service provider" means an organization that provides services for 11
the elderly pursuant to and in compliance with an agreement among the 12
provider, the Centers for Medicare and Medicaid Services, and the 13
Kentucky Department for Medicaid Services. 14
(2) Nothing in this chapter shall be construed to require a PACE service provider to 15
obtain a health facility license or certificate of need to provide PACE services. 16
(3) A PACE service provider shall be eligible to participate and enroll in the NBCP 17
to perform employment background checks. 18
