UNOFFICIAL COPY 24 RS BR 2379 Page 1 of 3 XXXX 2/26/2024 3:38 PM Jacketed AN ACT relating to terrorist activity and declaring an emergency. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 SECTION 1. A NEW SECTION OF KRS CHAPTER 158 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section: 5 (a) "Antisemitism" means hostility toward or discrimination against Jews as a 6 religious, ethnic, or racial group; 7 (b) "Designated terrorist organization" means an organization that has been 8 designated as a terrorist organization under the Immigration and 9 Nationality Act, 8 U.S.C. sec. 1189; 10 (c) "Material support or resources" has the same meaning as in 18 U.S.C. sec. 11 2339A; and 12 (d) "School" means a public school or public charter school located in 13 Kentucky. 14 (2) All school districts, public schools, and public charter schools shall act to protect 15 Jewish students from credible threats of violence or violence motivated by 16 antisemitism. 17 (3) (a) A school district, public school, public charter school, or student 18 organization affiliated with a public school or public charter school shall 19 not provide material support or resources to a designated terrorist 20 organization. 21 (b) If a school determines that an affiliated student organization has provided 22 material support or resources to a designated terrorist organization, the 23 school shall submit a report to the proper law enforcement authorities and 24 the school shall defund and disband the student organization. 25 SECTION 2. A NEW SECTION OF KRS CHAPTER 164 IS CREATED TO 26 READ AS FOLLOWS: 27 UNOFFICIAL COPY 24 RS BR 2379 Page 2 of 3 XXXX 2/26/2024 3:38 PM Jacketed (1) As used in this section: 1 (a) "Antisemitism" means hostility toward or discrimination against Jews as a 2 religious, ethnic, or racial group; 3 (b) "Designated terrorist organization" means an organization that has been 4 designated as a terrorist organization under the Immigration and 5 Nationality Act, 8 U.S.C. sec. 1189; 6 (c) "Institution" means a public postsecondary education institution and 7 includes all programs, departments, divisions, offices, centers, colleges, 8 student governments, and any individual acting in an official capacity on 9 behalf of a public postsecondary education institution; 10 (d) "Material support or resources" has the same meaning as in 18 U.S.C. sec. 11 2339A; and 12 (e) "Public funds" has the same meaning as in KRS 446.010. 13 (2) An institution shall act to protect its Jewish students from credible threats of 14 violence or violence motivated by antisemitism. 15 (3) An institution or student or faculty organization registered by or affiliated with 16 the institution shall not provide material support or resources to a designated 17 terrorist organization. If an institution determines that material support or 18 resources have been provided to a designated terrorist organization, the 19 institution shall: 20 (a) Submit a report to the proper law enforcement authorities; and 21 (b) If the material support or resources were provided by a student or faculty 22 organization, defund the student or faculty organization and terminate its 23 registration or affiliation with the institution. 24 SECTION 3. A NEW SECTION OF KRS CHAPTER 61 IS CREATE D TO 25 READ AS FOLLOWS: 26 (1) As used in this section, "antisemitism" means hostility toward or discrimination 27 UNOFFICIAL COPY 24 RS BR 2379 Page 3 of 3 XXXX 2/26/2024 3:38 PM Jacketed against Jews as a religious, ethnic, or racial group. 1 (2) In addition to considerations of unlawful discrimination on the basis of race, 2 religion, or natural origin, if there is an allegation that an unlawful 3 discriminatory practice or conduct is targeting an individual or group based on 4 any actual or perceived connection to any aspect of Jewish identity, a law 5 enforcement officer shall also consider whether the alleged unlawful 6 discriminatory conduct or practice was motivated by antisemitic intent. 7 SECTION 4. A NEW SECTION OF KRS CHAPTER 61 IS CREATED TO 8 READ AS FOLLOWS: 9 (1) As used in this section, "alien" has the same meaning as in 8 U.S.C. sec. 1101. 10 (2) Any alien who endorses or espouses terrorist activity in violation of the 11 Immigration and Nationality Act, including aliens on student or other temporary 12 visas, shall be subject to immediate arrest by a law enforcement officer and 13 transferred to the federal authorities for deportation proceedings. 14 Section 5. Antisemitism includes the examples set forth in House Resolution 15 41, adopted by the Kentucky House of Representatives on February 24, 2021. 16 Section 6. Whereas the General Assembly is committed to protecting Jewish 17 people, including Jewish students, from credible threats of violence or violence motivated 18 by antisemitism, an emergency is declared to exist, and this Act takes effect upon its 19 passage and approval by the Governor or upon its otherwise becoming a law. 20
