AN ACT relating to the Department of Public Advocacy. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘Section 1. KRS 31.140 is amended to read as follows: 3
A person who has been appropriately informed under KRS 31.120 may waive in writing, 4
or by other record, any right provided by this chapter, if the court concerned, at the time 5
of or after waiver, finds of record that he or she has acted with full awareness of his or 6
her rights and of the consequences of a waiver and if the waiver is otherwise according to 7
law. The court shall consider such factors as the person's age, education, and familiarity 8
with English, and the complexity of the crime involved. 9
