AN ACT relating to secretaries of boards of education. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 160.440 is amended to read as follows: 3 
Each board of education shall appoint a secretary for a term of one (1), two (2), three (3), 4 
or four (4) years. The secretary shall not be a member of the board of education or the 5 
superintendent.[ The board of education of any district may appoint its superintendent as 6 
secretary. However, a superintendent who serves as secretary to the board shall not 7 
receive compensation in addition to that which he receives for serving as superintendent.] 8 
The board may fix a reasonable salary for the secretary. The secretary shall keep the 9 
records of the board and perform other duties imposed upon him or her by the board. All 10 
orders of the board must be signed by the secretary and countersigned by the chairman of 11 
the board. The secretary shall be custodian of all securities, documents, title papers, and 12 
other papers of the board under such conditions as the board may direct. The secretary[, 13 
when other than the superintendent,] shall make all records of the board available to the 14 
superintendent and the board of education at any time and shall furnish the 15 
superintendent of schools and the board of education such information as is revealed by 16 
the records at any time upon the request of the superintendent or the board of education. 17
