A RESOLUTION acknowledging the events of January 6, 2021, at the United 1 
States Capitol and recognizing the citizens who have been held without due process. 2 
WHEREAS, citizens from across the United States, including this Commonwealth 3 
exercised their First Amendment rights of free speech and assembly to express their 4 
frustration with the electoral process on January 6, 2021; and 5 
WHEREAS, many of the citizens who assembled on January 6, 2021, have been 6 
wrongfully detained for exercising their constitutional rights; and 7 
WHEREAS, many of the January 6 protestors, including many citizens of this 8 
Commonwealth, have been unconstitutionally held without the right to due process and 9 
the right to a speedy trial by a jury of their peers; and 10 
WHEREAS, the Fifth and Fourteenth Amendments to the United States 11 
Constitution mandate that a person shall not "be deprived of life, liberty, or property 12 
without due process of law"; and 13 
WHEREAS, information on the events that led to the January 6, 2021, riots has 14 
been rapidly evolving as more becomes known to the public; and 15 
WHEREAS, much of the information to which the public has a right to know 16 
regarding January 6, 2021, has been withheld from the public; and 17 
WHEREAS, the Speaker of the United States House of Representatives, Michael 18 
Johnson, has released footage of the events that led to the January 6, 2021, riots so that 19 
the people can make intelligent and informed conclusions about what happened on 20 
January 6; and 21 
WHEREAS, in spite of efforts to provide all relevant information as to what led to 22 
the January 6, 2021, riots, much of that information is still being withheld from the 23 
public; and 24 
WHEREAS, as information about January 6, 2021, continues to be withheld from 25 
the public, many citizens, including citizens of this Commonwealth, continue to be 26 
unconstitutionally detained for exercising their constitutional rights; and 27  UNOFFICIAL COPY  	24 RS BR 1368

WHEREAS, the rights of freedom of speech, freedom of assembly, and due process 1 
are essential to a functioning democracy and are constitutionally guaranteed to all 2 
citizens; and 3 
WHEREAS, the Senate acknowledges the pressure and duress that many innocent 4 
January 6 protestors have endured, having been wrongfully accused or detained as 5 
prisoners in Washington, D.C., and whose lives and their families, have been adversely 6 
damaged while exercising their constitutional rights; 7 
NOW, THEREFORE, 8 
Be it resolved by the Senate of the General Assembly of the Commonwealth of 9 
Kentucky: 10 
Section 1. The members of the Senate hereby acknowledge the events of 11 
January 6, 2021, and recognize those citizens who have been wrongfully held without 12 
due process. 13 
Section 2. The Clerk of the Senate is directed to transmit a copy of this 14 
Resolution to Senator Lindsey Tichenor. 15
