UNOFFICIAL COPY 25 RS BR 1521 Page 1 of 2 XXXX 2/5/2025 1:58 PM Jacketed AN ACT relating to eggs. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 ď˘Section 1. KRS 260.550 is amended to read as follows: 3 (1) No person shall buy, sell, trade, traffic, or process eggs in Kentucky without a 4 license issued pursuant to the egg marketing law, with the following exceptions: 5 (a) Hatcheries purchasing eggs to be used exclusively for hatching purposes; 6 (b) Hotels, restaurants, and other eating places where all eggs purchased are 7 served in the establishment; 8 (c) Bakeries, confectioneries, and ice cream manufacturers who use eggs in a 9 manufactured product; 10 (d) Consumers buying eggs for their own consumption; or 11 (e) Producers who sell only directly to consumers and do not exceed a sales limit 12 of two hundred forty (240)[sixty (60)] dozen eggs per calendar week. 13 (2) Any person engaged in the act of selling shell eggs or egg products under any of the 14 following circumstances shall have all shell eggs and egg products placed under a 15 stop order: 16 (a) Selling or otherwise marketing shell eggs or egg products without a license; 17 (b) Selling or otherwise marketing shell eggs or egg products without first 18 submitting an emergency recall plan to the department; or 19 (c) Failing to remit or pay fines owed to the department. 20 (3) Any person engaged in the act of selling or otherwise marketing shell eggs under 21 the following conditions shall have those eggs placed under a stop order for: 22 (a) Failing to have the proper labels attached, as required by KRS 260.630; or 23 (b) Failing to meet the tolerances of consumer grades and consumer grade quality 24 standards, as required by KRS 260.620. 25 (4) Any person engaged in the act of selling or otherwise marketing shell eggs or egg 26 products shall have these shell eggs or egg products placed under a withdraw from 27 UNOFFICIAL COPY 25 RS BR 1521 Page 2 of 2 XXXX 2/5/2025 1:58 PM Jacketed sale order for the following reasons: 1 (a) Ambient temperature above forty-five (45) degrees Fahrenheit for a period of 2 four (4) hours or more; or 3 (b) Contamination or any condition which may render the shell eggs or egg 4 products unfit for human consumption. 5 The withdraw from sale order shall remain in effect until such time as the 6 disposition of the shell eggs or egg products has been determined by the 7 department. 8
