AN ACT relating to providing free feminine hygiene products for elementary and 1
secondary students. 2
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 158 IS CREATED TO 4
READ AS FOLLOWS: 5
(1) As used in this section, "feminine hygiene product" means tampons, sanitary 6
napkins, menstrual sponges, menstrual cups, and similar menstrual hygiene 7
products. 8
(2) All public schools and public charter schools that include any of grades four (4) 9
through twelve (12) shall make at least one (1) type of age-appropriate feminine 10
hygiene product available in each school building for use by female students at 11
no cost. 12
(3) Notwithstanding any provision of KRS 158.1415 to the contrary, each local board 13
of education and public charter school board of directors shall adopt policies: 14
(a) Establishing procedures for the distribution of age-appropriate feminine 15
hygiene products for use by female students and related guidance regarding 16
the safe and healthy use of the products; and 17
(b) Prohibiting the resale, redistribution, or misuse of feminine hygiene 18
products distributed to female students under this section. 19
