UNOFFICIAL COPY 25 RS BR 1904 Page 1 of 1 XXXX 2/19/2025 2:28 PM Jacketed AN ACT relating to keeping chickens on residential property. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 65 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section, "backyard chicken": 5 (a) Means a domesticated hen kept on residential property for personal egg 6 production and educational purposes, excluding commercial farming; and 7 (b) Shall not mean a domesticated rooster. 8 (2) A city, urban-county government, charter county government, consolidated local 9 government, or unified local government shall not enact or enforce any 10 ordinance, zoning regulation, or policy that directly or indirectly prohibits a 11 person from keeping six (6) or fewer backyard chickens on any residential 12 property. 13 (3) A city, urban-county government, charter county government, consolidated local 14 government, and unified local government may enact and enforce reasonable 15 ordinances regulations, or policies to ensure the health, safety, and welfare of 16 residents, including but not limited to: 17 (a) Setback requirements for coops holding backyard chickens from property 18 lines and neighboring residences; 19 (b) Sanitation and maintenance standards to control odors and pests; and 20 (c) Prohibiting the commercial sale of eggs or backyard chickens on residential 21 properties. 22 (4) Any ordinance, regulation, or policy that conflicts with this section shall be void 23 and unenforceable. 24
