A CONCURRENT RESOLUTION directing the establishment of the Automatic 1 
Expungement Task Force. 2 
WHEREAS, having a past conviction can make people ineligible for job 3 
opportunities, professional licenses, housing assistance, education, volunteering with 4 
their children’s activities, and more; and 5 
WHEREAS, expungement lowers rates of recidivism by offering people a clean 6 
slate and the opportunity to move forward as full members of their communities; and 7 
WHEREAS, over one million adults in Kentucky have a criminal record; and 8 
WHEREAS, as many as 44 percent of those adults may be eligible to have their 9 
record fully expunged; and 10 
WHEREAS, the current process for clearing eligible records can be confusing, 11 
expensive, and full of red tape; and 12 
WHEREAS, people should not be defined by their records and should have the 13 
opportunity to contribute to their community, to work, to get an education, and to achieve 14 
their full potential; and 15 
WHEREAS, it is time to ensure that a fair shot at redemption is available to all; 16 
NOW, THEREFORE, 17 
Be it resolved by the House of Representatives of the General Assembly of the 18 
Commonwealth of Kentucky, the Senate concurring therein: 19 
Section 1.   The Legislative Research Commission shall establish the Automatic 20 
Expungement Task Force. The task force shall review, study, and make recommendations 21 
regarding the development and implementation of electronic processes and procedures 22 
for the automatic expungement of records. The task force shall identify and address 23 
challenges that may arise during implementation to ensure an effective and efficient 24 
system. The task force shall investigate necessary systemic changes, technological 25 
requirements, cost estimates, and potential funding sources. 26 
Section 2.   The Automatic Expungement Task Force shall be composed of the 27  UNOFFICIAL COPY  	25 RS BR 2043

following members with final membership of the task force being subject to the 1 
consideration and approval of the Legislative Research Commission: 2 
(1) The Speaker of the House of Representatives, or his or her designee, who 3 
shall serve as co-chair of the task force; 4 
(2) The President of the Senate, or his or her designee, who shall serve as co-chair 5 
of the task force; 6 
(3) A representative from the Administrative Office of the Courts, appointed by 7 
the Chief Justice of the Supreme Court; 8 
(4) The president of the Kentucky Circuit Judges' Association, or his or her 9 
designee; 10 
(5) The president of the Kentucky District Judges' Association, or his or her 11 
designee; 12 
(6) The president of the Kentucky Association of Circuit Clerks, or his or her 13 
designee; 14 
(7) The president of the Kentucky Sheriffs' Association, or his or her designee; 15 
(8) The president of the Kentucky Association of Chiefs of Police, or his or her 16 
designee; 17 
(9) Two representatives from the Department of Kentucky State Police, appointed 18 
by the Secretary of the Justice and Public Safety Cabinet; 19 
(10) The president of the Kentucky Commonwealth's Attorneys' Association, or 20 
his or her designee; 21 
(11) The president of the County Attorneys Association, or his or her designee; 22 
(12) The public advocate, or his or her designee; and 23 
(13) Three representatives from the Clean Slate Kentucky coalition, including at 24 
least one impacted individual. 25 
Section 3.   The Automatic Expungement Task Force shall meet at least monthly 26 
during the 2025 Interim of the General Assembly unless otherwise directed by the 27  UNOFFICIAL COPY  	25 RS BR 2043

Legislative Research Commission, and shall be staffed by the Legislative Research 1 
Commission. 2 
Section 4.   The Automatic Expungement Task Force shall submit a report of its 3 
findings and recommendations to the Legislative Research Commission no later than 4 
November 1, 2025, for referral to the General Assembly and consideration in the 2026 5 
Regular Session. The report may include a legislative proposal. 6 
Section 5.   Provisions of this Resolution to the contrary notwithstanding, the 7 
Legislative Research Commission shall have the authority to alternatively assign the 8 
issues identified herein to an interim joint committee or subcommittee thereof and to 9 
designate a study completion date. 10
