AN ACT relating to liability for injury or damage caused by the underage 1
consumption of intoxicating substances. 2
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 411 IS CREATED TO 4
READ AS FOLLOWS: 5
(1) As used in this section, "minor" means a person under twenty-one (21) years of 6
age. 7
(2) Any person who sustains injury or property damage, or the estate of any person 8
killed, as a proximate result of the negligence of an intoxicated minor shall have, 9
in addition to any other cause of action available in tort, a cause of action 10
against: 11
(a) Any person who knew or should have known through the use of ordinary 12
care that a minor consumed alcohol or another intoxicating or controlled 13
substance not medically prescribed to the minor in the person's home or on 14
property under the person's control; and 15
(b) Any person, other than the minor's parent, who furnished, delivered, or 16
procured for the minor the alcohol or other intoxicating or controlled 17
substance not medically prescribed to the minor. 18
