AN ACT relating to the forensic processing of firearms. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
SECTION 1.   A NEW SECTION OF KRS CHAPTER 15 IS CREATED TO 3 
READ AS FOLLOWS: 4 
(1) When a law enforcement agency seizes or recovers a firearm that was unlawfully 5 
possessed, used for any unlawful purpose, recovered from the scene of a crime, is 6 
reasonably believed to have been used or associated with the commission of a 7 
crime, or is acquired by the agency as an abandoned or discarded firearm, the 8 
agency shall: 9 
(a) Transmit to and receive from the National Crime Information Center 10 
system information relating to that firearm; 11 
(b) Transmit to and receive from the United States Alcohol, Tobacco, Firearms 12 
and Explosives eTrace system information relating to that firearm; and 13 
(c) Arrange for every such firearm to be test-fired as soon as practicable and 14 
the results of that test-firing be submitted to the National Integrated 15 
Ballistic Identification Network to determine whether the firearm is 16 
associated with or related to a crime, criminal conduct, any individual 17 
associated with or related to a crime or criminal conduct, or reasonably 18 
believed to be associated or related to a crime or criminal conduct. 19 
(2) When a law enforcement agency recovers any spent shell casing at a crime scene 20 
or has reason to believe that the recovered spent shell casing is related to or 21 
associated with the commission of a crime or the unlawful discharge of a firearm, 22 
the agency shall, as soon as practicable, submit the ballistics information to the 23 
National Integrated Ballistic Identification Network. 24 
(3) Local law enforcement agencies shall develop policies and procedures, approved 25 
by the Justice and Public Safety Cabinet, for the recovery and forensic processing 26

possessed, used for any unlawful purpose, recovered from the scene of a crime, or 1 
reasonably believed to have been used or associated with the commission of a 2 
crime. 3
