ELECTED OFFICIALS:  (Constitutional Amendment) Provides term limits for judges,
district attorneys, and sheriffs
A JOINT RESOLUTION1
Proposing to add Article V, Section 35 of the Constitution of Louisiana, relative to term2
limits; to provide term limits for judges, district attorneys, and sheriffs; to provide3
for applicability; to provide for submission of the proposed amendment to the4
electors; and to provide for related matters.5
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members6
elected to each house concurring, that there shall be submitted to the electors of the state of7
Louisiana, for their approval or rejection in the manner provided by law, a proposal to add8
Article V, Section 35 of the Constitution of Louisiana, to read as follows:9
§35.  Limitation on Terms; Judges; District Attorneys; Sheriffs10
Section 35.(A)(1) Judges.  No person who at the end of his term of office11
will have served as a judge in the same office for more than two and one-half terms12
in three consecutive terms shall be elected to the same office for the succeeding term.13
(2) District Attorneys.  No person who at the end of his term of office will14
have served in the office of district attorney for more than two and one-half terms in15
three consecutive terms shall be elected to the office of district attorney for the16
succeeding term.17
(3) Sheriffs.  No person who has served in the office of sheriff for more than18
two and one-half terms in three consecutive terms shall be elected to the office of19

(B) Applicability.  This Section shall not apply to any term which began1
prior to January 1, 2011.2
Section 2. Be it further resolved that this proposed amendment shall be submitted3
to the electors of the state of Louisiana at the statewide election to be held on November 2,4
2010.5
Section 3. Be it further resolved that on the official ballot to be used at said election6
there shall be printed a proposition, upon which the electors of the state shall be permitted7
to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall8
read as follows:9
To provide term limits for judges, district attorneys, and sheriffs; to limit10
judges to two and one-half terms in three consecutive terms in the same11
office; to limit district attorneys and sheriffs to two and one-half terms in12
three consecutive terms in office.  (Adds Article V, Section 35)13

Present constitution provides for the election and terms of judges, district attorneys, and
sheriffs.
Proposed constitutional amendment retains present constitution, but limits the number of
consecutive terms a person may serve in these offices. Prohibits a person who at the end of
his term of office will have served as a judge in the same office for more than 2-1/2 terms
in three consecutive terms from being elected to the same office for the succeeding term.
Prohibits a person who at the end of his term of office will have served in the office of
district attorney for more than 2-1/2 terms in three consecutive terms from being elected to
the office of district attorney for the succeeding term. Prohibits a person who has served in
the office of sheriff for more than 2-1/2 terms in three consecutive terms from being elected
to the office of sheriff for the succeeding term.
Provides that proposed constitutional amendment shall not apply to any term which began
prior to Jan. 1, 2011.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Nov. 2, 2010.
