TEACHERS:  Removes state funding restrictions relative to planning time for teachers
AN ACT1
To amend and reenact R.S. 17:434(A), relative to required planning time for teachers; to2
remove state funding restrictions; to provide an effective date; and to provide for3
related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 17:434(A) is hereby amended and reenacted to read as follows: 6
ยง434.  Planning time and lunch periods for teachers; required7
A.(1)  The State Board of Elementary and Secondary Education shall adopt8
necessary rules and regulations requiring, beginning with the 2000-2001 school year,9
each city and parish school board to provide a minimum of forty-five minutes daily10
planning time, or its weekly equivalent, and a minimum of thirty minutes for lunch11
each day which shall be duty-free for every teacher actively engaged in the12
instruction and supervision of students in the public schools.  Implementation of13
planning time and lunch periods as required in this Section for teachers shall not14
result in a lengthened school day.15
(2) The provisions of this Subsection shall be subject to the availability of16
state funds for this purpose.17

Section 2. This Act shall become effective on July 1, 2010; if vetoed by the governor1
and subsequently approved by the legislature, this Act shall become effective on July 1,2
2010, or on the day following such approval by the legislature, whichever is later.3

Abstract: Removes funding restrictions relative to required planning time for teachers.
Present law requires the Board of Elementary and Secondary Education to adopt rules and
regulations to require each school board to provide teachers with at least 45 minutes of daily
planning time during the school day and at least 30 minutes of lunch time.  Provides,
however, that the availability of state funding for such purpose is a condition for the
effectiveness of present law.
Proposed law removes the funding requirement of present law.
Effective July 1, 2010.
