COASTAL RES/COASTAL ZONE:  Provide for buffer zone for borrow pits sites
AN ACT1
To enact R.S. 49:214.30(C)(10), relative to coastal use permits; to provide for buffer zones2
between certain activities and structures; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1. R.S. 49:214.30(C)(10) is hereby enacted to read as follows:5

C. The rules promulgated pursuant to this Section shall, among other things,8
provide that:9

(10) No coastal use permit shall be issued nor shall concurrence be granted11
to any other permit to excavate any borrow pit within two hundred feet of any12
residence, school, church, or hospital.13

Present law prohibits use of a state or local concern in the coastal zone without receiving a
coastal use permit and authorizes the secretary of the Dept. of Natural Resources to
promulgate rules and regulations on the issuance of such permits.
Proposed law prohibits the issuance of a coastal use permit or concurrence to any other
permit to excavate any borrow pit within two hundred feet of any residence, school, church,
or hospital.
