CLERKS OF COURT: Streamlines the fees the clerks of district courts charge in criminal
matters
AN ACT1
To amend and reenact R.S. 13:847(A)(1) through (8) and to repeal R.S. 13:846(A)(1)(b) and2
847(A)(9) through (38), (B), and (C), relative to fees charged and received in3
criminal cases; to consolidate the fees charged by the clerks of the district courts,4
except Orleans Parish, in criminal matters; to increase certain fees the clerks of court5
charge in criminal matters; to repeal certain fees the clerks of court charge in6
criminal matters; and to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 13:847(A)(1) through (8) are hereby amended and reenacted to read9
as follows: 10
ยง847.  Fees in criminal cases; exceptions11
A.  The clerks of court may charge the following fees and no more in all12
criminal cases:  In addition to other fees fixed by law, the clerks of the several13
district courts throughout the state of Louisiana shall be entitled to demand and14
receive the following fees:15
(1)  For filing, docketing, and registering an affidavit, thirty-five cents. In all16
criminal misdemeanor cases where, as a part of the sentence imposed the accused is17
ordered to pay court costs, the sum of fifty dollars shall be assessed, collected, and18
paid over to the clerk of court by the sheriff.19 HLS 10RS-1140	ENGROSSED

(2)  For filing appearance bond, thirty-five cents.  In all criminal felony cases1
where, as a part of the sentence imposed the accused is ordered to pay court costs,2
the sum of one hundred dollars shall be assessed, collected, and paid over to the clerk3
of court by the sheriff.4
(3)  For filing testimony, thirty-five cents. Copies per page, one dollar.5
(4)  For filing a bill of information, thirty-five cents.  Conformed copies,6
three dollars.7
(5)  Orders bringing accused into court and remanding from court to prison8
in each case for one or more accused, fifty cents.  Certification of copies, five9
dollars.10
(6) For arraignment of one or more accused and entering the several pleas,11
in each case, seventy-five cents. Criminal history search, twenty dollars.12
(7) For notice of trial to principal, fifty cents. Extract of court minutes, ten13
dollars.14
(8) For subpoenas to witnesses, copies, and seal, forty cents. United States15
Postal Service and common carriers, costs actually incurred.16

Section 2. R.S. 13:846(A)(1)(b) and 847(A)(9) through (38), (B), and (C) are hereby18
repealed in their entirety. 19

Abstract: Streamlines the fees the clerks of district courts charge in criminal cases, except
the parish of Orleans.
Present law provides for 38 separate fees the clerks of court charge in criminal matters for
services provided, except the parish of Orleans. 
Proposed law provides that in criminal misdemeanor cases where, as a part of the sentence
imposed the accused is ordered to pay court costs, the sum of $50 shall be assessed,
collected, and paid over to the clerk of court by the sheriff and in felony cases $100. HLS 10RS-1140	ENGROSSED

Proposed law provides that the clerks of court are entitled to receive $1 for copies per page,
$3 for conformed copies, $5 for certification of copies, $20 for criminal history search, $10
for an extract of court minutes, and costs actually incurred for U.S. Postal Service and
common carriers.
Proposed law repeals 38 specific fees the clerks of court charge for services rendered and
a fee of $7.50 as court costs the clerk receives from criminal prosecutions.
