ACT No. 733 Regular Session, 2010 HOUSE BILL NO. 1060 BY REPRESENTATIVE RICHMOND AN ACT1 To amend and reenact R.S. 13:846(A)(1)(b) and 847(A)(1) through (8) and to repeal R.S.2 13:847(A)(9) through (38), (B), and (C), relative to fees charged and received in3 criminal and traffic cases; to consolidate the fees charged by the clerks of the district4 courts in criminal matters; to provide for fees the clerks of court charge in criminal5 and traffic matters; to repeal certain fees the clerks of court charge in criminal6 matters; and to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 13:846(A)(1)(b) is hereby amended and reenacted to read as follows:9 §846. Additional fees; attending court sessions; transcripts of appeal in criminal10 cases; costs of prosecution; forfeited bail bond 11 A. In addition to other fees fixed by law, the clerks of the several district12 courts throughout the state of Louisiana, the parish of Orleans excepted, shall be13 entitled to demand and receive the following fees of office:14 (1)15 * * *16 (b) In all criminal cases involving traffic offenses under Title 32 of the17 Louisiana Revised Statutes of 1950 where when as a part of the sentence imposed18 the accused is condemned to pay costs of prosecution, the sum of seven dollars and19 fifty cents shall be assessed, collected, and paid over to the clerk of court by the20 sheriff as the clerk's fee.21 * * *22 ENROLLEDHB NO. 1060 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Section 2. R.S. 13:846(A)(1)(b) is hereby amended and reenacted to read as follows:1 §846. R.S. 13:847(A)(1) through (8) are hereby amended and reenacted to read15 as follows: 16 §847. Fees in criminal cases; exceptions17 A. The clerks of court may charge the following fees and no more in all18 criminal cases: In addition to other fees fixed by law, the clerks of the several19 district courts throughout the state of Louisiana shall be entitled to demand and20 receive the following fees:21 (1)(a) For filing, docketing, and registering an affidavit, thirty-five cents. In22 criminal misdemeanor cases involving traffic offenses under Title 32 of the23 Louisiana Revised Statutes of 1950 when, as a part of the sentence imposed the24 accused is ordered to pay court costs, in addition to other costs authorized by law or25 local court rule as of August 15, 2010, the sum of five dollars shall be assessed,26 collected, and paid over to the clerk of court by the sheriff.27 (b) In all other criminal misdemeanor cases when, as a part of the sentence28 imposed the accused is ordered to pay court costs, the sum of fifty dollars shall be29 assessed, collected, and paid over to the clerk of court by the sheriff.30 ENROLLEDHB NO. 1060 Page 3 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (2) For filing appearance bond, thirty-five cents. In all criminal felony cases1 when, as a part of the sentence imposed the accused is ordered to pay court costs, the2 sum of one hundred dollars shall be assessed, collected, and paid over to the clerk3 of court by the sheriff.4 (3) For filing testimony, thirty-five cents. Copies per page, one dollar.5 (4) For filing a bill of information, thirty-five cents. Conformed copies,6 three dollars.7 (5) Orders bringing accused into court and remanding from court to prison8 in each case for one or more accused, fifty cents. Certification of copies, five9 dollars.10 (6) For arraignment of one or more accused and entering the several pleas,11 in each case, seventy-five cents. Criminal history search, twenty dollars.12 (7) For notice of trial to principal, fifty cents. Extract of court minutes, ten13 dollars.14 (8) For subpoenas to witnesses, copies, and seal, forty cents. United States15 Postal Service and common carriers, costs actually incurred.16 * * *17 Section 4. R.S. 13:847(A)(9) through (38), (B), and (C) are hereby repealed in their18 entirety. 19 Section 5.
