WORKERS COMPENSATION:  Provides relative to the determination of wages for
professional athletes
AN ACT1
To amend and reenact R.S. 23:1021(12)(c), relative to the determination of wages for the2
purposes of workers' compensation; to provide for wages for professional athletes3
under certain circumstances; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 23:1021(12)(c) is hereby amended and reenacted to read as follows:6

(12) "Wages" means average weekly wage at the time of the accident.  The9
average weekly wage shall be determined as follows:10

(c)  Annual wages.  12
(I) If the employee is employed at an annual salary, his annual salary divided13
by fifty-two.14
(ii) If the employer is a professional athlete who signs a contract for hire and15
is on the official club roster, and the professional athlete is injured during the regular16
season, then the professional athlete's annual weekly wage shall be determined by17
the professional athlete's contract in force at the time of the injury.  If the employee18
is a professional athlete who signs a contract for hire and is not on the official club19

then the professional athlete's average weekly wage shall be calculated based on the1
actual off-season or pre-season wages earned at the time of the injury.2

Abstract: Relative to workers' compensation, provides for the determination of average
weekly wages for professional athletes.
Present law defines wages, for the purposes of workers' compensation, as the average weekly
wage at the time of the accident. Present law provides for determination of annual wages
as an employee's annual salary divided by 52 if the employee is paid an annual salary.
Proposed law provides that professional athletes who sign a contract for hire and are on the
official club roster and are injured during the regular season shall have their weekly wage
calculated by the contract in force at the time of their injury. Also provides that a
professional athlete who signs a contract and is not on the official club roster during the
regular season and is injured during the off-season or pre-season shall have his weekly wage
calculated based on the actual off-season or pre-season wages earned at the time of the
injury.
