Regular Session, 2010 HOUSE BILL NO. 1077 BY REPRESENTATIVES JANE SMITH, BARRAS, CONNICK, CROMER, DANAHAY, GEYMANN, HENRY, LIGI, PONTI, PUGH, AND SMILEY ADMIN LAW/DIVISION: Provides that the director of the division of administrative law is appointed by the chief justice of the supreme court instead of the governor AN ACT1 To amend and reenact R.S. 49:995(A) and (B)(2), relative to the director of the division of2 administrative law; to provide for the appointment of the director; to provide3 procedures relative to the appointment; to provide for effectiveness; and to provide4 for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 49:995(A) and (B)(2) are hereby amended and reenacted to read as7 follows:8 ยง995. Director9 A. The governor shall appoint, and the Senate shall confirm, chief justice of10 the supreme court shall appoint, subject to confirmation by the Senate, a director for11 the division, who shall have the following qualifications:12 (1) The director shall be a resident of Louisiana.13 (2) The director shall be licensed to practice law in Louisiana.14 (3) The director shall have been engaged in the actual practice of law for at15 least five years prior to his appointment.16 B.17 * * *18 HLS 10RS-1636 ORIGINAL HB NO. 1077 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (2) If a vacancy occurs during the director's term, the governor chief justice1 of the supreme court shall appoint a successor to fill the remainder of the vacant2 term.3 * * *4 Section 2. Present law provides for the division of administrative law and provides for the director of the division. Provides that the director is appointed by the governor and confirmed by the Senate for a six-year term. Requires the director to be a resident of Louisiana; be licensed to practice law in Louisiana; and have been engaged in the actual practice of law for at least five years prior to his appointment. Provides that the director is a full-time unclassified employee and prohibits the director from accepting or engaging in additional employment of any kind. Provides that a vacancy is filled by appointment for the remainder of the term. Proposed law provides instead that the director is appointed by the chief justice of the supreme court subject to confirmation by the Senate and otherwise retains present law. Proposed law specifies that the provisions of proposed law shall not affect the term of office of the person holding the office of director of the division of administrative law on the effective date of proposed law.
