CONTRACTORS/CONSTRUCTI ON:  Provides relative to licensure by the State Licensing
Board for Contractors
AN ACT1
To amend and reenact R.S. 37:2166 and 2167.1(D), relative to the authority of the2
Residential Building Contractors Subcommittee of the State Licensing Board for3
Contractors to adopt continuing education requirements; to provide that the4
subcommittee may adopt continuing education requirements; to provide that an5
inactive licensee shall be required to fulfill all prescribed continuing education6
requirements established, if any have been established by the subcommittee, for7
active licensees; and to provide for related matters.8
Be it enacted by the Legislature of Louisiana:9
Section 1. R.S. 37:2166 and 2167.1(D) are hereby amended and reenacted to read10
as follows: 11
§2166.  Powers and duties12
A. Subject to the approval of the State Licensing Board for Contractors, the13
subcommittee shall have the following powers and duties:14
(1) To adopt rules and regulations to govern residential building contractors15
in the state of Louisiana.16
(2) To issue, suspend, modify, or revoke licenses to do business in the state17
of Louisiana pursuant to the provisions of R.S. 37:2158.18
(3) To prescribe and adopt regulations and policies for continuing education.19

approve for use by licensees any continuing education courses or written training1
programs provided by a member of the subcommittee or legal entity in which he has2
a controlling interest.3
(4) (3) To cause the prosecution and enjoinder of all persons violating4
provisions of this Chapter, and incur necessary expenses therefor.5
B. Subject to the approval of the State Licensing Board for Contractors, the6
subcommittee may prescribe and adopt regulations and policies for continuing7
education; however, notwithstanding any other law to the contrary, the subcommittee8
shall not approve for use by licensees any continuing education courses or written9
training programs provided by a member of the subcommittee or legal entity in10
which he has a controlling interest.11

Present law provides that, subject to the approval of the State Licensing Board for
Contractors, the Residential Building Contractors Subcommittee shall have the following

law, and incur necessary expenses therefor.
Proposed law retains present law but clarifies that the subcommittee is authorized to
prescribe and adopt regulations and policies for continuing education but is not required by
law to do so.
Present law requires an inactive licensee to fulfill all prescribed continuing education
requirements established for active licensees.
Proposed law retains present law but clarifies that an inactive licensee is only required to
fulfill all prescribed continuing education requirements if any have been adopted by the
subcommittee.
