Regular Session, 2010 HOUSE BILL NO. 1098 BY REPRESENTATIVE HENRY WORKERS COMPENSATION: Provides for a reduction or offset of workers' compensation for professional athletes AN ACT1 To enact R.S. 23:1225(D), relative to workers' compensation for professional athletes; to2 provide for a reduction or offset of compensation benefits for professional athletes;3 and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 23:1225(D) is enacted to read as follows:6 ยง1225. Reductions when other benefits payable7 * * *8 D. The compensation benefits payable to a professional athlete pursuant to9 any provision of this Chapter shall be reduced or offset by an amount equal to the10 total amount of benefits, wages, or other type of payment mentioned in any part of11 this Subsection on a dollar-for-dollar basis and not just on a week-to-week basis, if12 a professional athlete receives payment or remuneration from any of the following13 or payment of any type from any of the following: wages or benefits payable or paid14 to the athlete, collective bargaining agreements, contract hire of any type, severance15 pay, injured reserve pay, termination pay, grievance or settlement pay, workers'16 compensation benefit of any type, payment made to the professional athlete by the17 employer pursuant to any contract or agreement whatsoever.18 HLS 10RS-1710 ORIGINAL HB NO. 1098 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law provides an employer a limited reduction in compensation benefits only when the employee is receiving certain other specially enumerated benefits. Proposed law provides that workers' compensation benefits for a professional athlete shall be reduced or off set by an amount equal to the total amount of benefits, wages or other type of payment on a dollar for dollar basis and not just a week to week basis if the athlete receives payment of any type from wages or benefits payable or paid to the athlete, collective bargaining agreements, contract hire of any type, severance pay, injured reserve pay, termination pay, grievance or settlement pay, workers' compensation benefit of any type, payment made to the professional athlete by the employer pursuant to any contract or agreement whatsoever and to provide for related matters.
