Regular Session, 2010 HOUSE BILL NO. 1100 BY REPRESENTATIVE DIXON INSURANCE: Authorizes the distribution of a portion of the Two Percent Fire Insurance Fund to the England Economic and Industrial Development District AN ACT1 To enact R.S. 22:347(A)(2)(c), relative to the disposition of tax money; provides for the2 distribution of a portion of the Two Percent Fire Insurance Fund to the England3 Economic and Industrial Development District; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 22:347(A)(2)(c) is hereby enacted to read as follows: 6 ยง347. Disposition of tax money7 A. Monies collected under R.S. 22:342 through 349, after being first credited8 to the Bond Security and Redemption Fund in accordance with Article VII, Section9 9 (B) of the Constitution of Louisiana, shall be credited to a special fund hereby10 established in the state treasury and known as the "Two Percent Fire Insurance Fund"11 hereinafter the "fund". [R.S. 1:13(B) and 24:177(E)] Dixon HB No. 1100 Abstract: Authorizes distribution of a portion of monies credited to the Two Percent Fire Insurance Fund to the England Economic and Industrial Development District. Present law provides that monies collected, after being first credited to the Bond Security and Redemption Fund, shall be credited to a special fund known as the "Two Percent Fire Insurance Fund" and shall be appropriated annually by the legislature for the state fire marshal to purchase group insurance for volunteer firefighters. Present law further provides that monies in the fund be available in amounts appropriated annually by the legislature for specific purposes in the following order of priority: (1)(a)An amount necessary for the purchase of group insurance for volunteer firefighters. (b)An amount necessary for the purchase of workers compensation insurance for volunteer firefighters. (2)(a)$70,000 per year to the Pine County Education Center in Webster Parish to develop and operate a firefighter training center operated in accordance with the standards and requirements of the Fire and Emergency Training Institute at LSU at Baton Rouge. (b)$70,000 per year to the Delgado Community College to develop and operate a firefighter training center operated in accordance with the standards and requirements of the Fire and Emergency Training Institute at LSU at Baton Rouge. (3)$70,000 per year to the Fire and Emergency Center at LSU for support of the firefighter training program. (4)For distribution to each parish governing authority based upon the formula: (a)Except in Orleans Parish, the state treasurer shall pay over to the treasurer of each governing authority of the parish described in R.S. 22:343 the full amount of money due as determined by the state treasurer. These funds shall be allocated, distributed, and paid to each parish on the basis of a determination of the established population category of each parish as shown by the latest federal census or as determined by the Division of Business and Economic Research of Louisiana Tech University under the latest federal-state cooperative program for local population estimates. Such determination shall be submitted by the Division of Business and Economic Research of Louisiana Tech University to the state treasurer annually not later than Jan. 15 th of each calendar year. The determination so submitted shall have no effect on the distribution for the fiscal year in which it is made, but shall be utilized for purposes of this Subpart for distribution during the next ensuing fiscal year as follows: (i)Those regularly paid fire departments of an incorporated municipality or fire and waterworks district in any unincorporated municipality or active volunteer fire departments having a population within its geographical area of 1 to 2500 shall receive $750 per year. (ii)Those regularly paid fire departments of an incorporated municipality or fire and waterworks district in any unincorporated municipality or active volunteer fire departments having a population of 2501 to 5000 shall receive $1000 per year. (iii)Those regularly paid fire departments of an incorporated municipality or fire and waterworks district in any unincorporated municipality or active volunteer fire departments having a population of 5001 one or more shall receive $1250 per year. (b)Additional funds shall be distributed to each parish based on the following population formula: (i)Where the population is 24,000 or less, the parish shall receive 34 cents for each inhabitant. (ii)Where the population is 24,001 to 55,000 inclusive, the parish shall receive 37 cents per inhabitant. (iii)Where the population is 55,001 to 100,000 inclusive, the parish shall receive 40 cents per inhabitant. (iv)Where the population is 100,001 to 250,000 inclusive, the parish shall receive 44 cents per inhabitant. (v)Where the population is 250,001 to 425,000 inclusive, the parish shall receive 47 cents per inhabitant. (vi)Where the population is over 425,000, the parish shall receive 50 cents per inhabitant. (c)Any balance which remains after making the distributions required in present law shall be allocated on an equal per capita basis until all of the available funds are utilized. (d)If the total amount of monies available for distribution pursuant to present law is less than the 100% required to fully implement such formula, the amount distributed shall be prorated equally among the formula categories by the state treasurer prior to distribution to each parish governing authority. Proposed law adds to priority (2) of present law $70,000 per year to the institute for allocation to the England Economic and Industrial Development District in the parish of Rapides to develop and operate a firefighter training center in accordance with the standards and requirements of the Fire and Emergency Training Institute at LSU at Baton Rouge. Provides that monies shall be transferred from the Fire and Emergency Training Institute at LSU at Baton Rouge to the England Economic and Industrial Development District without cost or administrative fee.
