ACT No. 985 Regular Session, 2010 HOUSE BILL NO. 1139 BY REPRESENTATIVE GREENE AN ACT1 To amend and reenact R.S. 47:463.102, relative to the Rotary District 6200 special prestige2 license plate; to provide for the name; to provide for eligibility; to provide for3 distribution and use of royalty fees; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 47:463.102 is hereby amended and reenacted to read as follows:6 ยง463.102. Special prestige license plates; Louisiana Rotary District 62007 A. The secretary of the Department of Public Safety and Corrections shall8 establish a special prestige license plate, to be known as the Louisiana Rotary9 District 6200, hereafter referred to as the "organization", plate, subject to the10 provisions of this Section. The license plate shall be restricted to passenger cars,11 pickup trucks, vans, and recreational vehicles. The color and design of the license12 plate shall be selected by Rotary District 6200 the Louisiana Rotary organization13 hereafter referred to as the "organization". The license plate shall contain the14 organization's logo, provided it is in compliance with R.S. 47:463(A)(3), and shall15 bear the words "SERVICE ABOVE SELF".16 B. The license plate shall be issued, upon application, to any member in17 good standing of the organization citizen of Louisiana in the same manner as any18 other motor vehicle license plate and as provided for in this Section.19 C. A one-time royalty fee of twenty-five dollars for use of the organization's20 logo shall be collected from the applicant and forwarded to the organization the21 Rotary District 6200 Foundation, for each license plate issued and renewed as22 provided in this Section, and shall be accompanied by identification of the parish in23 which the applicant is domiciled. The department shall also collect the standard24 motor vehicle registration license fee provided for in R.S. 47:463 and a handling fee25 ENROLLEDHB NO. 1139 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. of three dollars and fifty cents. The handling fee shall be retained by the department1 to offset a portion of administrative costs.2 D. The monies received from the royalty fees by the organization foundation,3 shall be used solely for charitable purposes for residents of the state of Louisiana and4 shall be distributed to the Rotary district in the parish of the applicant's domicile, as5 reported to the foundation by the department. The organization foundation shall be6 responsible for establishing and disbursing the funds for charitable purposes.7 E. The secretary shall establish a prestige license plate for the organization8 in accordance with the provisions of this Section when all of the following9 conditions are met:10 (1) All necessary contracts regarding use of the organization's logo have11 been executed.12 (2) The secretary has received a minimum of one thousand applications for13 the license plate.14 F. The secretary shall establish rules and regulations as are necessary to15 implement the provisions of this Section, including but not limited to rules and16 regulations governing the collection and disbursement of royalty fees, verification17 that an applicant is a member of the organization, the transfer and disposition of such18 license plates, the colors available, and the design criteria.19 SPEAKER OF THE HOUSE OF REPRESENTATI VES PRESIDENT OF THE SENATE GOVERNOR OF THE STATE OF LOUISIANA APPROVED:
