GERMAIN, STIAES, TALBOT, TEMPLET, THIBAUT, THIERRY, TUCKER, WADDELL, WILLIAMS, WILLMOTT, AND WOOTON AND SENATORS CROWE AND MURRAY AN ACT1 To enact R.S. 47:463.141, relative to motor vehicle special prestige license plates; to honor2 the 2009 World Champion New Orleans Saints; to provide for the creation and3 issuance of such plates; to provide for the design of such plates; to provide relative4 to the fee and application of the fee for such plates; to authorize the promulgation of5 rules and regulations; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 47:463.141 is hereby enacted to read as follows:8 ยง463.141. Special prestige license plate; "World Champion New Orleans Saints";9 distribution of royalty fees10 A. The secretary of the Department of Public Safety and Corrections shall11 establish a special prestige motor vehicle license plate to commemorate the New12 Orleans Saints World Football Champions for the 2009 season, provided that there13 is a minimum of one thousand applicants for such plates. The license plate shall be14 restricted to use on passenger cars, pickup trucks, recreational vehicles, and vans.15 B. The prestige license plate shall be issued, upon application, to any person,16 in the same manner as any other motor vehicle license plate.17 ENROLLEDHB NO. 1165 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. C. The license plate shall be designed by the New Orleans Saints in1 consultation with the state of Louisiana, through the office of motor vehicles.2 D. The charge for the special prestige license plate shall be the standard3 motor vehicle license tax imposed by Article VII, Section 5 of the Constitution of4 Louisiana plus an annual royalty fee of twenty-five dollars for each plate, to be5 collected by the department every two years upon renewal of the plate. A handling6 fee of three dollars and fifty cents shall also be charged and retained by the7 department to offset a portion of administrative cost.8 E. The first three hundred plates shall be reserved for purchase at the9 direction of the New Orleans Saints.10 F. The annual royalty fee shall be collected by the department and deposited11 into the Louisiana Stadium and Exposition District License Plate Fund. The money12 received from the royalty fees shall be used solely to pay debt service on state debt13 issued to fund improvements to the Louisiana Superdome.14 G. There is hereby created, as a special fund within the state treasury, the15 Louisiana Stadium and Exposition District License Plate Fund, hereafter sometimes16 referred to as the "Fund". Notwithstanding any other provision of law, after17 compliance with the requirements of Article VII, Section 9(B) of the Constitution of18 Louisiana relative to the Bond Security and Redemption Fund, and after a sufficient19 amount is allocated to pay all of the obligations secured by the full faith and credit20 of the state which become due and payable within any fiscal year, the treasurer shall21 pay an amount equal to the annual royalty fee collected by the department into the22 Fund. All of the monies in the Fund shall be appropriated each year by the23 legislature to the Louisiana Stadium and Exposition District for application first to24 pay principal and interest on any debt issued by the Louisiana Stadium and25 Exposition District and second to pay any operating expenses of the Louisiana26 Stadium and Exposition District.27 H.
