PROPERTY/RIGHTS:  Provides for the right to utilize propane gas as an energy source
AN ACT1
To enact R.S. 9:1105, relative to storage tanks; to provide for certain rights relative to the2
placement of certain storage tanks; to provide for an exemption; to provide for3
preemption; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 9:1105 is hereby enacted to read as follows:6
ยง1105.  Storage tanks; right of use7
A. A property owner may place, install, or use storage tanks containing8
alternative gases, including but not limited to propane, on his property to function9
as an energy source. Each storage tank shall be approved by the Louisiana Liquefied10
Petroleum Gas Commission.11
B. The provisions of this Section shall not be applicable to a parish with a12
population of more than four hundred fifty thousand but less than four hundred13
seventy-five thousand persons.14
C. Nothing in this Section shall be construed to preempt any municipal or15

Proposed law allows a property owner to place, install, or use storage tanks containing
alternative gases, including but not limited to propane on his property to function as an
energy source.
Proposed law requires each storage tank be approved by the La. Liquefied Petroleum Gas
Commission.
Proposed law provides that provisions of proposed law shall not preempt any municipal or
parish ordinance in effect on or before Aug. 15, 2010.
Proposed law exempts a parish with a population of more than 450,000 but less than 475,000
from provisions of proposed law.
