Regular Session, 2010 HOUSE BILL NO. 1344 BY REPRESENTATIVE AUSTIN BADON SCHOOLS/BOARDS: Permits the governing authority of a public elementary or secondary school to provide for the placement of advertisements on school buses AN ACT1 To enact R.S. 17:81(T), relative to the powers, duties, functions, and responsibilities of city,2 parish, and other local public school boards; to authorize the governing authority of3 a public elementary or secondary school to provide for the placement of certain4 advertisements in and on school buses; to provide for rules and regulations; and to5 provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 17:81(T) is hereby enacted to read as follows:8 ยง81. General powers of city, parish, and other local public school boards9 * * *10 T.(1) Notwithstanding any rule, regulation, or law to the contrary, the11 governing authority of a public elementary or secondary school may provide for the12 display of advertisements on school buses according to rules and regulations13 developed and adopted by the State Board of Elementary and Secondary Education.14 Such rules and regulations shall include but not be limited to a prohibition of15 advertisements which pertain to the following:16 (a) Alcoholic beverages or tobacco products.17 (b) Content which is discriminatory, false, misleading, deceptive, or obscene.18 (c) The endorsement of any product or service by the school governing19 authority.20 HLS 10RS-2497 ENGROSSED HB NO. 1344 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Present law provides generally for the powers, duties, functions, and responsibilities of public school boards. Proposed law authorizes, notwithstanding any rule, regulation, or law to the contrary, a public school governing authority to provide for the placement of advertisements in and on school buses according to BESE rules and regulations. Requires such rules and regulations to include, at a minimum, a prohibition of advertisements which pertain to the following: (1) Alcoholic beverages or tobacco products. (2) Content which is discriminatory, false, misleading, deceptive, or obscene. (3) The endorsement of any product or service by the school governing authority. (4)Support or opposition relative to any public official or candidate for public office or to the passage of any tax, levy, bond issue, or other election issue. (5)The promotion of gaming. Further provides that costs associated with the implementation of proposed law shall not be borne by the public school governing authority. (Adds R.S. 17:81(T)) Summary of Amendments Adopted by House Committee Amendments Proposed by House Committee on Education to the original bill. 1. Broadened prohibition of political advertisements to cover all such advertisements rather than only those expressing the position of the school governing authority. 2. Added to the list of prohibited advertisements those pertaining to the promotion of gaming.
