CHILD DAY CARE: Provides an exception to the designation of "day care center" for
certain entities
AN ACT1
To enact R.S. 46:1427, relative to child care facilities and child-placing agencies; to provide2
for an exception to the designation of "day care center" for certain entities; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 46:1427 is hereby enacted to read as follows: 6
ยง1427.  Exceptions7
For the purposes of this Chapter, the designation of "day care center" as8
provided in R.S. 46:1403 shall not apply to the following entities:9
(1) Any organization which is qualified as a tax-exempt organization under10
Section 501(c)(3) of the Internal Revenue Code and which operates a facility in11
which no child remains for more than twenty-four hours in one continuous stay.12
(2) Any prekindergarten program for three-year-old or four-year-old children13
located at a public or nonpublic school serving children in grades one and above and14
approved by the Board of Elementary and Secondary Education.15
Section 2. This Act shall become effective upon signature by the governor or, if not16
signed by the governor, upon expiration of the time for bills to become law without signature17
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If18
vetoed by the governor and subsequently approved by the legislature, this Act shall become19

Abstract: Exempts certain entities from being classified as a "day care center".
Proposed law provides that the following two types of entities shall not be considered "day
care centers" for the purposes of Chapter 14 of Title 46 of the La. R.S.:
(1)Any organization which is qualified as a tax-exempt organization under Section
501(c)(3) of the Internal Revenue Code and which operates a facility in which no
child remains for more than twenty-four hours in one continuous stay.
(2)Any prekindergarten program for three-year-old or four-year-old children located at
a public or nonpublic school serving children in grades one and above and approved
by the Board of Elementary and Secondary Education.
Effective upon signature of governor or lapse of time for gubernatorial action.
