Regular Session, 2010 HOUSE BILL NO. 1374 BY REPRESENTATIVE ABRAMSON SCHOOLS/DISTRICTS: Provides relative to the authority of the Recovery School District to receive, manage, and expend certain insurance proceeds AN ACT1 To amend and reenact R.S. 17:1990(B)(4)(b)(iii), relative to the Recovery School District;2 to provide relative to the authority of the district to receive, manage, and expend3 certain insurance proceeds paid or payable to the prior system; to provide for4 retroactive application; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 17:1990(B)(4)(b)(iii) is hereby amended and reenacted to read as7 follows: 8 ยง1990. A4 portion of all revenues available to the prior system which are dedicated to the repair,5 maintenance, or capital projects regarding a transferred school whether such revenue6 is available from tax proceeds, was borrowed, bonded, or was otherwise acquired7 shall be transferred by the system to the recovery district in an amount equal to the8 proportion that the number of schools transferred from such school system bears to9 the total number of schools operated by the school system during the school year10 immediately proceeding the school year in which the transfer occurred.11 * * *12 Section 3. Present law creates the Recovery School District (RSD) and provides for its powers and authority. Authorizes the RSD to receive, manage, and expend all state, local, or federal funding for repairing, renovating, or rebuilding, or building a school or facility and all insurance proceeds attributable to damage done to any property except the portion used to pay certain debt owed. Requires a specified portion of revenues to be transferred to the RSD. Proposed law retains present law but specifies that the insurance proceeds are those paid or payable to the prior school system attributable to damage done to property on or after Aug. 28, 2005, and provides for retroactive application of proposed law to Aug. 28, 2005, and prospective application.
