WATER/RESOURCES: Provides for the landowner's right of use of running water adjacent
to his estate
AN ACT1
To enact R.S. 9:1103, relative to water use rights; to provide for the use of running water by2
an adjacent landowner for certain purposes; to provide for a transfer of a water use3
servitude; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 9:1103 is hereby enacted to read as follows: 6
ยง1103.  Use and consumption of running water by owner of adjacent estate7
An estate owner has the right to use running water adjacent to his estate for8
any agricultural purpose or the production of minerals. Use includes any purpose for9
such water which returns it to the land or waters of the state.  A servitude may be10
granted by the estate owner to a third party for the right of use of the running water.11
