PUBLIC CONTRACT/BIDS: Requires the submission of information regarding
subcontractors for bids with DBE participation goals
AN ACT1
To enact R.S. 38:2212(K), relative to public contracts, works, and improvements; to require2
certain information be included in the submission of a bid for which a contract3
disadvantaged business enterprise goal has been established; and to provide for4
related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 38:2212(K) is hereby enacted to read as follows: 7
§2212. Advertisement and letting to lowest responsible bidder; public work;8
electronic bidding; participation in mentor-protégé program; exemptions9

K. A public entity shall require that any bid for public work for which a11
contract disadvantaged business enterprise goal has been established shall include12
a plan for meeting the contract disadvantaged business enterprise participation goal.13
Bids shall include the name of any disadvantaged business enterprise subcontractors14
who will participate in the contract, a clear and concise description of the work to be15
performed by each disadvantaged business enterprise subcontractor, written16
confirmation from the disadvantaged business enterprise that it is participating in the17
contract as detailed in the prime contractor's plan, and the dollar amount of each18
proposed disadvantaged business enterprise subcontract.19

Abstract: If a public works project has a goal for disadvantaged business enterprise (DBE)
participation, bids must include certain information on DBE subcontractors.
Present law (Public Bid Law) provides for the timing and submission of bids for public
works projects and the purchase of materials or supplies by the state and its political
subdivisions.
Proposed law requires that a public entity shall require that any bid for public work for
which a contract disadvantaged business enterprise (DBE) goal has been established shall
include a plan for meeting the DBE participation goal. Provides that bids include the
following information regarding any DBE subcontractors:
(1)The name of any DBE subcontractors.
(2)A clear and concise description of the work to be performed by each DBE
subcontractor.
(3)Written confirmation from the DBE that it is participating in the contract as detailed
in the prime contractor's plan.
(4)The dollar amount of each proposed DBE subcontract.
