ACT No. 949 Regular Session, 2010 HOUSE BILL NO. 1418 BY REPRESENTATIVE FOIL AN ACT1 To enact R.S. 32:1735.1, relative to storage of motor vehicles; to allow law enforcement2 agencies to place holds on motor vehicles stored at a licensed storage facility; to3 provide for notification; to provide for payment of the storage of the motor vehicle;4 and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 32:1735.1 is hereby enacted to read as follows: 7 ยง1735.1. Motor vehicle holds; storage requirements; notification; payment of8 storage costs9 A. Any law enforcement agency may place a hold on a vehicle stored at a10 licensed storage facility for up to fourteen calendar days.11 B. A law enforcement agency may request extension of a hold placed12 pursuant to Subsection A of this Section. In order to extend a hold, the law13 enforcement agency shall notify the storage facility in writing prior to expiration of14 the initial hold. If the law enforcement agency does not request extension of such15 hold, the storage facility shall release the vehicle to its owner upon payment by such16 owner of all towing and storage charges to the storage facility, provided that the17 storage facility has complied with the provisions of R.S. 32:1719 and 1720. 18 C. When a law enforcement agency extends its hold pursuant to Subsection19 B of this Section, the law enforcement agency may remove the vehicle to a20 designated impound lot.21 D. When a law enforcement agency extends its hold pursuant to Subsection22 B of this Section and elects to continue storage of the motor vehicle at the storage23 facility, the law enforcement agency shall be responsible for payment of the storage24 ENROLLEDHB NO. 1418 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. facility's charges during the requested hold extension period; however, the owner of1 the motor vehicle shall be responsible for payment of the storage facility's towing2 and storage charges during the initial law enforcement hold period.3 E. Upon judicial determination of no probable cause, a law enforcement4 agency shall release its hold on the impounded vehicle.5 F.
