Regular Session, 2010 HOUSE BILL NO. 1454 BY REPRESENTATIVE PATRICIA SMITH HOUSING: Creates the Housing and Transportation Planning and Coordinating Commission AN ACT1 To enact Chapter 3-G of Title 40 of the Louisiana Revised Statutes of 1950, to be comprised2 of R.S. 40:600.101 and R.S. 36:4(P), relative to coordination of housing and3 transportation planning; to create the Housing and Transportation Planning and4 Coordinating Commission within the division of administration and to provide for5 its membership, operation, powers, and duties; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. Chapter 3-G of Title 40 of the Louisiana Revised Statutes of 1050,8 comprised of R.S. 40:600.101, is hereby enacted to read as follows: 9 CHAPTER 3-G. HOUSING AND TRANSPORTATI ON 10 PLANNING AND COORDINATING COMMISSION11 §600.101. Housing and transportation coordination12 A. The Housing and Transportation Planning and Coordinating Commission13 is hereby created within the division of administration. B.(1) The commission shall be comprised of the following members:1 (a) One member appointed by the commissioner of administration to2 represent the office of community development.3 (b) One member appointed by the commissioner of administration to4 represent the office of facility planning and control.5 (c) The secretary of the Department of Transportation and Development or6 his designee.7 (d) The secretary of the Department of Social Services or his designee.8 (e) The board of commissioners of the Louisiana Housing Agency shall9 appoint one member to represent the agency.10 (f) A representative of the Louisiana Housing Finance Alliance selected by11 the alliance.12 (g) A representative of the regional planning commissions appointed by the13 commissioner of administration.14 (h) A representative of the Center for Planning Excellence selected by the15 center.16 (i) Two representatives of nonprofit housing development organizations17 appointed by the commissioner of administration.18 (2) Members of the commission appointed pursuant to Paragraphs (B)(1) and19 (2) of this Section shall serve at the pleasure of the appointing authority. Members20 of the commission appointed pursuant to Paragraphs (B)(5) through (9) of this21 Section shall serve four-year terms. A vacancy in the office of a member shall be22 filled in the same manner as the original appointment for the remainder of the23 unexpired term.24 (3) The commission shall elect a chairman and such other officers as it25 deems necessary from among its members. (5) The commissioner of administration shall provide staff and other support1 for the commission and shall call the first meeting of the commission.2 C.(1) The commission shall create a statewide housing plan. In the3 development and maintenance of the plan, the commission shall conduct a parish by4 parish assessment of housing. The assessment shall be conducted once every five5 years and the plan shall be updated based on the most recent assessment. All parish6 governing authorities and local housing authorities shall cooperate with the7 commission in the conduct of the assessment.8 (2) The assessments shall document the following:9 (a) The overall supply of housing, including single-family, multi-family,10 special needs, and institutional housing.11 (b) The conditions of the housing stock.12 (c) The housing cost burden.13 (d) Access to transit and job centers.14 (3) The commission shall hold not fewer than three public hearings to15 provide for citizen participation in the development of the plan. Each such hearing16 shall be held at a different time of day and on a different day of the week from the17 other meetings in order to maximize the opportunity for citizen participation.18 D. The commission shall also have the following powers and duties:19 (1) To define planning and housing regions.20 (2) To determine public and alternative transportation needs.21 (3) To estimate low and moderate income housing needs.22 (4) To set criteria and guidelines for parishes and municipalities to determine23 and address their local affordable housing needs.24 (5) To set criteria and guidelines for parishes, municipalities, and25 metropolitan planning organizations to coordinate and address local and regional26 transportation needs.27 (6) To review and approve housing and transportation plans for parishes and28 municipalities.29 HLS 10RS-2603 ORIGINAL HB NO. 1454 Page 4 of 6 CODING: Words in struck through type are deletions from existing law; words underscored are additions. E.(1) In accordance with the plan developed pursuant to Subsection C of this1 Section and in partnership with parish governing authorities, the commission shall2 promote the targeting of federal housing funds to areas of greatest need.3 (2) The commission shall work in partnership with the Department of4 Transportation and Development to ensure that not less than fifteen percent of5 federal and state funds appropriated for highway and bridge construction be utilized6 for alternative modes of transportation, including public transit, bus rapid transit, rail,7 and bike paths.8 Section 2.
