BUILDING CODES:  Provides for changes to the La. State Uniform Construction Code
AN ACT1
To enact R.S. 40:1730.28(A)(3)(f), relative to building codes; to prohibit the adoption of a2
code or regulation requiring sprinklers in one- and two-family dwellings; to prohibit3
the adoption of an ordinance requiring sprinklers in one- and two-family dwellings;4
and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 40:1730.28(A)(3)(f) is hereby enacted to read as follows: 7
ยง1730.28. Mandatory adoption of certain nationally recognized codes and standards8
as the state uniform construction code; adoption by reference9
A. Except as provided in Subsection C of this Section, the council shall10
evaluate, adopt, and amend only the latest editions of the following as the state11
uniform construction code:12

(f) The council shall not adopt or enforce any part of the International16
Residential Code or any other code or regulation that requires a fire protection17
sprinkler system in one- or two- family dwellings. Further, no municipality or parish18
shall adopt or enforce an ordinance or other regulation requiring a fire protection19

Section 2. This Act shall become effective upon signature by the governor or, if not2
signed by the governor, upon expiration of the time for bills to become law without signature3
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If4
vetoed by the governor and subsequently approved by the legislature, this Act shall become5
effective on the day following such approval.6

Abstract: Prohibits the adoption or enforcement of any building code, local ordinance, or
other regulation that requires a fire protection sprinkler system in one- or two- family
dwellings.
Proposed law prohibits the La. State Uniform Construction Code Council from adopting or
enforcing any part of the International Residential Code or any other code or regulation that
requires a fire protection sprinkler system in one- or two- family dwellings.
Proposed law further prohibits a municipality or parish from adopting or enforcing an
ordinance or other regulation requiring a fire protection sprinkler system in one- or two-
family dwellings.
Effective upon signature of governor or lapse of time for gubernatorial action.
