ACT No. 685 Regular Session, 2010 HOUSE BILL NO. 206 BY REPRESENTATIVES FANNIN, BOBBY BADON, BALDONE, BARROW, BURFORD, CARMODY, CHANDLER, CHANEY, CONNICK, CROMER, DIXON, DOWNS, ELLINGTON, GEYMANN, GI SCLAIR, GUINN, HENDERSON, HOWARD, KATZ, LABRUZZO, LEBAS, LEGER, LIGI, LOPINTO, LORUSSO, NOWLIN, PUGH, RICHARD, SCHRODER, SIMON, GARY SMITH, AND WOOTON AN ACT1 To enact R.S. 40:1730.28(A)(3)(f) and (g), relative to building codes; to prohibit the2 adoption of a code or regulation requiring sprinklers in one- and two-family3 dwellings; to prohibit the adoption of an ordinance requiring sprinklers in one- and4 two-family dwellings; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 40:1730.28(A)(3)(f) and (g) are hereby enacted to read as follows:7 ยง1730.28. Mandatory adoption of certain nationally recognized codes and standards8 as the state uniform construction code; adoption by reference9 A. Except as provided in Subsection C of this Section, the council shall10 evaluate, adopt, and amend only the latest editions of the following as the state11 uniform construction code:12 * * *13 (3)14 * * *15 (f) The council shall not adopt or enforce any part of the International16 Residential Code or any other code or regulation that requires a fire protection17 sprinkler system in one- or two-family dwellings. (g) Factory built homes shall be inspected in accordance with the codes in1 effect for the locality where the home will be ultimately sited, on the date2 construction begins in the factory.3 * * *4 Section 2. This Act shall become effective upon signature by the governor or, if not5 signed by the governor, upon expiration of the time for bills to become law without signature6 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
