Regular Session, 2010 HOUSE BILL NO. 302 BY REPRESENTATIVE SMILEY BOARDS/COMMISSIONS: Provides relative to disclosure of information concerning certain boards and commissions AN ACT1 To amend and reenact R.S. 49:1303(A) and (B) and 1304(B) and to enact R.S.2 49:1305(A)(3), relative to boards, commissions, and like entities; to provide relative3 to disclosure of certain information concerning certain boards, commissions, and like4 entities; to provide for the publication of such information on the Internet; to provide5 for the powers and duties of the commissioner of administration relative thereto; and6 to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 49:1303(A) and (B) and 1304(B) are hereby amended and reenacted9 and R.S. 49:1305(A)(3) is hereby enacted to read as follows:10 §1303. Submission of notices and minutes; posting11 A.(1) Each board, commission, or like entity covered by this Chapter shall12 submit each notice required to be included on the website pursuant to R.S.13 49:1302(A) to the commissioner of administration in a manner which allows the14 commissioner enough time to post the notice on the website prior to the deadline15 applicable to the board, commission, or like entity for giving notice pursuant to R.S.16 42:7.17 (2) The commissioner of administration shall ensure that each notice is18 posted on the website as soon as possible after receipt.19 HLS 10RS-908 ORIGINAL HB NO. 302 Page 2 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. B.(1) Each board, commission, or like entity covered by this Chapter shall1 submit minutes required to be included on the website pursuant to R.S. 49:1302(B)2 to the commissioner of administration within ten days after the minutes are adopted3 by the board, commission, or like entity.4 (2) The commissioner of administration shall ensure that minutes are posted5 on the website no later than ten business days after receiving them.6 * * *7 §1304. Submission of other information; posting8 * * *9 B.(1) Except as provided in R.S. 49:1303, each board, commission, or like10 entity covered by this Chapter shall submit to the commissioner of administration all11 information required to be included on the website pursuant to R.S. 49:1302,12 including any change in information previously submitted, no later than thirty days13 after the information becomes available to the board, commission, or like entity.14 (2) The commissioner of administration shall ensure that the information15 described in Paragraph (1) of this Subsection is posted on the website no later than16 ten business days after receiving it.17 * * *18 §1305. Applicability19 A. This Chapter shall apply to the following boards, commissions, and like20 entities:21 * * *22 (3) Each board and commission whose members are required to file annual23 financial disclosure statements pursuant to R.S. 42:1124.2.1.24 * * *25 Section 2.(A) Prior to the effective date of this Act, the commissioner of26 administration shall take all reasonable and necessary actions, including contacting boards,27 commissions, and like entities covered by this Act, to ensure that the information on the28 HLS 10RS-908 ORIGINAL HB NO. 302 Page 3 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. website will be complete as required by this Act and Chapter 20 of Title 49 of the Louisiana1 Revised Statutes of 1950 on the effective date of this Act.2 (B) Prior to the effective date of this Act, each board, commission, or like entity3 covered by this Act shall fully cooperate with the commissioner of administration in4 implementing and complying with the requirements of this Section. Prior to the effective5 date of this Act, each board, commission, and like entity covered by this Act shall provide6 the information required by this Act and Chapter 20 of Title 49 of the Louisiana Revised7 Statutes of 1950 to the commissioner of administration as soon as possible to allow for the8 inclusion of the information on the website on the effective date of this Act.9 Section 3. Present law (effective March 1, 2010) requires the commissioner of administration to establish and maintain a website to post certain specified information concerning certain boards and commissions, including notices and minutes, statutory citations, contact information, membership information, employee information, information concerning the budget and finances of the board or commission, and rules and regulations of the board or commission. Provides deadlines for submitting such information to the commissioner of administration. Further provides that all submissions of required information be made electronically in a format designated by the commissioner of administration. Present law applies to any board, commission, or like entity that is a licensing agency pursuant to present law (Licensing Agency Budget Act–R.S. 39:1332) and to the La. Board of Cosmetology (R.S. 37:571). Provides further that present law applies to any committee, subcommittee, or panel of any such licensing agency or of the La. Board of Cosmetology. Proposed law retains present law. Requires the commissioner of administration to ensure that each notice received from a board, commission, or like entity is posted on the website as soon as possible after receipt and that other information must be posted on the website no later than ten business days after receiving it. Expands the number of boards and commissions required to submit information by including each board and commission whose members are required to file annual financial disclosure statements pursuant to present law (Code of Governmental Ethics–R.S. 42:1124.2; present law requires that the following file financial disclosure statements: (1)Each member and any designee of a member of a board or commission that has the authority to expend, disburse, or invest $10,000 or more in a fiscal year. (2)Each member of the State Civil Service Commission. (3)Each member of the Board of Commissioners of the La. Stadium and Exposition District. Effective Jan. 1, 2011.
