Regular Session, 2010 HOUSE BILL NO. 302 BY REPRESENTATIVE SMILEY BOARDS/COMMISSIONS: Provides relative to disclosure of information concerning certain boards and commissions AN ACT1 To amend and reenact R.S. 49:1302(E) and to enact R.S. 49:1305(A)(3) and 1307, relative2 to boards, commissions, and like entities; to provide relative to disclosure of certain3 information concerning certain boards, commissions, and like entities; to provide for4 the publication of such information on the Internet; to provide for the powers and5 duties of the commissioner of administration relative thereto; to provide for the6 powers and duties of the legislative auditor relative thereto; and to provide for related7 matters.8 Be it enacted by the Legislature of Louisiana:9 Section 1. R.S. 49:1302(E) is hereby amended and reenacted and R.S. 49:1305(A)(3)10 and 1307 are hereby enacted to read as follows:11 §1302. (2) The information required by this Subsection shall include per diem and1 reimbursement for travel expenses, including the amount of such expenses paid per2 meeting and an aggregate amount of such expenses paid per fiscal year.3 * * *4 §1305. Applicability5 A. This Chapter shall apply to the following boards, commissions, and like6 entities:7 * * *8 (3) Each board and commission whose members are required to file annual9 financial disclosure statements pursuant to R.S. 42:1124.2.1.10 * * *11 §1307. Legislative auditor12 The legislative auditor shall work with the commissioner of13 administration to ensure that each board, commission, or like entity covered14 by this Chapter complies with the provisions of this Chapter.15 Section 2.(A) Prior to the effective date of this Act, the commissioner of16 administration shall take all reasonable and necessary actions, including contacting boards,17 commissions, and like entities covered by this Act, to ensure that the information on the18 website will be complete as required by this Act and Chapter 20 of Title 49 of the Louisiana19 Revised Statutes of 1950 on the effective date of this Act.20 (B) Prior to the effective date of this Act, each board, commission, or like entity21 covered by this Act shall fully cooperate with the commissioner of administration in22 implementing and complying with the requirements of this Section. Prior to the effective23 date of this Act, each board, commission, and like entity covered by this Act shall provide24 the information required by this Act and Chapter 20 of Title 49 of the Louisiana Revised25 Statutes of 1950 to the commissioner of administration as soon as possible to allow for the26 inclusion of the information on the website on the effective date of this Act.27 Section 3. Present law (effective March 1, 2010) requires the commissioner of administration to establish and maintain a website to post certain specified information concerning certain boards, commissions, and like entities, including notices and minutes, statutory citations, contact information, membership information, employee information, information concerning the budget and finances of the board or commission, and rules and regulations of the board or commission. Provides deadlines for submitting such information to the commissioner of administration. Further provides that all submissions of required information be made electronically in a format designated by the commissioner of administration. Proposed law specifies that the information concerning compensation required by present law to be posted on the website include per diem and reimbursement for travel expenses, including the amount of such expenses paid per meeting and an aggregate amount of such expenses paid per fiscal year. Otherwise retains present law. Present law applies to any board, commission, or like entity that is a licensing agency pursuant to present law (Licensing Agency Budget Act–R.S. 39:1332) and to the La. Board of Cosmetology (R.S. 37:571). Provides further that present law applies to any committee, subcommittee, or panel of any such licensing agency or of the La. Board of Cosmetology. Proposed law retains present law. Expands the number of boards and commissions required to submit information by including each board and commission whose members are required to file annual financial disclosure statements pursuant to present law (Code of Governmental Ethics–R.S. 42:1124.2), which requires, subject to certain exceptions, that the following file financial disclosure statements: (1)Each member and any designee of a member of a board or commission (as that term is defined in present law) that has the authority to expend, disburse, or invest $10,000 or more in a fiscal year. (2)Each member of the State Civil Service Commission. (3)Each member of the Board of Commissioners of the La. Stadium and Exposition District. Proposed law requires the legislative auditor to work with the commissioner of administration to ensure that each board, commission, or like entity covered by present law complies with the provisions of present law. Effective May 1, 2011. Summary of Amendments Adopted by House Committee Amendments Proposed by House Committee on House and Governmental Affairs to the original bill. 1. Removed proposed requirement that the commissioner of administration ensure that each notice received from a board, commission, or like entity is posted on the website as soon as possible after receipt and that other information be posted on the website no later than 10 business days after receiving it. 2. Added requirement that the legislative auditor work with the commissioner of administration to ensure that each board, commission, or like entity covered by proposed law complies with the provisions of proposed law. 3. Added requirement that information concerning compensation required by present law to be posted on the website include per diem and reimbursement for travel expenses, including the amount of such expenses paid per meeting and an aggregate amount of such expenses paid per fiscal year. 4. Changed the effective date of proposed law from Jan. 1, 2011 to May 1, 2011.
