Regular Session, 2010 HOUSE BILL NO. 374 BY REPRESENTATIVE LOPINTO TRAFFIC: Limits fines imposed for traffic offenses captured by automated traffic enforcement systems AN ACT1 To enact R.S. 32:41(F) and 42(D), relative to fines imposed for traffic violations; to limit2 fines and fees imposed for traffic violations captured by automated traffic3 enforcement systems; to provide restrictions for late fees; to provide for time limits4 for payment of fines and fees; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 32:41(F) and 42(D) are hereby enacted to read as follows:7 §41. Power of local municipal authorities8 * * *9 F.(1) No ordinance or regulation adopted pursuant to this Section shall10 impose a fine of more than fifty dollars for a traffic violation captured by an11 automated traffic enforcement system.12 (2) No ordinance or regulation shall require a fine imposed for a traffic13 violation captured by an automated traffic enforcement system to be due less than14 sixty days from mailing of the traffic violation notice.15 (3) No ordinance or regulation shall impose a late fee of more than twenty16 dollars for each month an imposed fine is past due for a traffic violation captured17 by an automated traffic enforcement system.18 (4) For the purposes of this Subsection, the term "automated traffic19 enforcement system" means a camera or optical device installed to work in20 HLS 10RS-1200 ORIGINAL HB NO. 374 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. conjunction with a traffic control signal or radar speed detection equipment, or both,1 and designed to record images that depict the license plate or other identifying2 feature of a motor vehicle that is not operated in compliance with instruction of a3 traffic control signal or a posted traffic sign.4 §42.
