WEAPONS/FIREARMS:  Increases penalties for carrying a firearm or discharging a firearm
during a parade
AN ACT1
To amend and reenact R.S. 14:95.2.1(A) and 95.2.2(D), relative to firearms at parades; to2
increase the penalties for the illegal carrying of a firearm at a parade with any3
firearm used in the commission of a crime of violence; to increase the penalties for4
the reckless discharge of a firearm at a parade; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 14:95.2.1(A) and 95.2.2(D) are hereby amended and reenacted to7
read as follows: 8
§95.2.1. Illegal carrying of a firearm at a parade with any firearm used in the9
commission of a crime of violence10
A. Whoever commits the crime of illegal carrying of weapons pursuant to11
R.S. 14:95 with any firearm used in the commission of a crime of violence as defined12
in R.S. 14:2(B), within one thousand feet of any parade or demonstration for which13
a permit is issued by a governmental entity, shall be fined not more than two14
thousand dollars, or imprisoned, with or without hard labor, for not less than one15
year nor more than five ten years, or both. Any sentence issued pursuant to the16
provisions of this Subsection and any sentence issued pursuant to a violation of a17
crime of violence as defined in R.S. 14:2(B) shall be served consecutively.18

§95.2.2.  Reckless discharge of a firearm at a parade or demonstration1

D. Whoever commits the crime of reckless or negligent discharge of a3
firearm at a parade or demonstration shall be sentenced to imprisonment at hard4
labor for not less than five nor more than ten twenty-five years, at least three years5
of the sentence imposed shall be served without benefit of parole, probation, or6
suspension of sentence and shall be fined not more than five thousand dollars.7

Abstract: Increases penalties for the illegal carrying and reckless discharge of a firearm
during a parade.
Present law provides for the crime of illegal carrying of a firearm within 1,000 feet of a
parade and provides for criminal penalties including a fine of not more than $2,000,
imprisonment, with or without hard labor, for not less than one year nor more than five
years, or both.
Proposed law increases the maximum penalty from five years  to 10 years imprisonment and
otherwise retains present law.
Present law provides for the crime of the reckless or criminally negligent discharge of a
firearm at a parade and provides for criminal penalties including imprisonment at hard labor
for not less than five nor more than 10 years, with at least three years served without benefit
of parole, probation, or suspension of sentence, and a fine of not more than $5,000.
Proposed law increases the maximum penalty from 10 years to 25 years imprisonment and
otherwise retains present law.
