BONDS: Provides relative to the rate for commercial surety underwriters writing criminal
bail bonds
AN ACT1
To amend and reenact R.S. 22:1443, relative to the premium rate on criminal bail bonds;2
provides for an increase in the dollar amount applicable to commercial surety3
underwriters writing criminal bail bonds; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 22:1443 is hereby amended and reenacted to read as follows: 6
ยง1443.  Premium on criminal bail bond7
The premium rate set for commercial surety underwriters writing criminal8
bail bonds in the various courts throughout the state of Louisiana shall not be subject9
to the rates set by the insurance commissioner, but shall be set and adjusted by the10
legislature. The rate for all commercial surety underwriters writing criminal bail11
bonds in the state of Louisiana shall be twelve percent of the face amount of the12
bond, or sixty one hundred dollars, whichever is greater. Any additional fee13
authorized by R.S. 13:718(I)(2) shall not be included in this premium rate and shall14
be exclusive of the limit set by this Section. All other provisions of the code relating15
to enforcement of the rate shall be effective and enforced in accordance with all parts16
of this Section.17
Section 2. This Act shall become effective upon signature by the governor or, if not18
signed by the governor, upon expiration of the time for bills to become law without signature19

vetoed by the governor and subsequently approved by the legislature, this Act shall become1
effective on the day following such approval.2

Abstract: Provides relative to the premium rate for commercial surety underwriters writing
criminal bail bonds.
Present law provides that the premium rates for commercial surety underwriters writing
criminal bail bonds in the various courts throughout the state of La. are not subject to the
rates set by the commissioner of insurance.  Specifies that these rates are set and adjusted
by the legislature. Establishes the premium rate for commercial surety underwriters at 12%
of the face amount of the bond or $60, whichever is greater.  Specifies that any additional
authorized premium fee shall not be included in this premium rate and is exclusive of the
limit set in present law.  Specifies that all other enforcement provisions are effective and
may be enforced in accordance with law. 
Proposed law increases the dollar amount applicable to commercial surety underwriters
writing criminal bail bonds from $60 to $100.
Effective upon signature of governor or lapse of the time for gubernatorial action.
