Regular Session, 2010 HOUSE BILL NO. 444 BY REPRESENTATIVE ROSALIND JONES CORRECTIONS: Provides limitations on the number of inmates participating in work release programs AN ACT1 To amend and reenact R.S. 15:711(A) and to enact R.S. 15:1111.1, relative to work release2 programs; to provide limitations on inmates who can participate in certain work3 release programs; to provide for the adoption of rules establishing the maximum4 capacity of work release participants for each correctional facility; and to provide for5 related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 15:711(A) is hereby amended and reenacted and R.S. 15:1111.1 is8 hereby enacted to read as follows: 9 §711. Work release program10 A. The sheriff of each parish, and in Orleans Parish, the criminal sheriff, is11 hereby authorized to establish and administer a work release program for inmates12 who are residents of the parish within his jurisdiction, or an adjoining parish, and13 who are sentenced to confinement in of any jail or prison under his located in that14 jurisdiction. In the event that the inmate is confined to a parish correctional facility15 not operated by the sheriff, then the superintendent of the correctional facility is16 hereby authorized to establish and administer a work release program for inmates of17 the correctional facility under his jurisdiction, and where the word sheriff is used18 herein it shall also mean superintendent of the correctional facility wherein the19 inmate is confined.20 * * *21 HLS 10RS-1088 ORIGINAL HB NO. 444 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. §1111.1. Work release programs; rules; limitations1 A. The Department of Public Safety and Corrections shall adopt rules to2 provide for establishment of the maximum capacity of inmates to be placed on work3 release at each correctional facility throughout the state.4 B. The department shall take into consideration the following factors in5 developing the rules:6 (1) The population of the parish where the correctional facility is located.7 (2) Likelihood of successful job placement and opportunity upon completion8 of work release and release from incarceration.9 (3) The availability of training facilities, instructors, and the number of10 inmates eligible to participate in work release programs.11 (4) The financial stability, business integrity, and other economic factors of12 the community where the correctional facility is located.13 (5) The economic feasibility of the operation of the work release program.14 (6) Any other criteria deemed relevant by the department.15 (7) The reduction in recidivism by participation in the program.16 C. Proposed law retains the provisions of present law and provides that work release inmates participating in sheriff's work release shall be residents of the parish within his jurisdiction, or an adjoining parish. Proposed law provides that DPS&C shall adopt rules to provide for establishment of the maximum capacity of inmates to be placed on work release at each correctional facility throughout the state.
