CRIMINAL/RECORDS:  Authorizes the La. Real Estate Commission to access criminal
history information
AN ACT1
To amend and reenact R.S. 15:587(A)(1)(a), relative to criminal identification and2
information; to authorize the Louisiana Real Estate Commission to access all3
criminal history record information maintained by the Louisiana Bureau of Criminal4
Identification and Information; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 15:587(A)(1)(a) is hereby amended and reenacted to read as follows:7
ยง587. Duty to provide information; processing fees; Louisiana Bureau of Criminal8
Identification and Information9
A.(1)(a) The bureau shall make available upon request, or at such other times10
as the deputy secretary shall designate, to any eligible criminal justice agency and11
the Department of Health and Hospitals, the state fire marshal when reviewing12
applications for licensure, the Department of Social Services, the Department of13
Insurance, the Louisiana State Racing Commission, the Senate and Governmental14
Affairs Committee, the executive director of the Louisiana Workforce Commission15
or his designee, the Board of River Port Pilot Commissioners, the Office of Financial16
Institutions in the office of the governor, the Louisiana Real Estate Commission in17
the office of the governor, the office of the disciplinary counsel of the Louisiana18
Attorney Disciplinary Board of the Louisiana State Bar Association; however, as to19

a formal charge against the attorney, the municipal or parish department or personnel1
responsible for reviewing applications for alcoholic beverage outlet permits and the2
legislative auditor any information contained in the criminal history record and3
identification files of the bureau. The Department of Social Services may provide4
information secured pursuant to this Subsection to all federal and state agencies5
providing child support enforcement services.6

Section 2. This Act shall become effective upon signature by the governor or, if not8
signed by the governor, upon expiration of the time for bills to become law without signature9
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If10
vetoed by the governor and subsequently approved by the legislature, this Act shall become11
effective on the day following such approval.12

Abstract: Authorizes the La. Real Estate Commission to access all criminal history record
information maintained by the La. Bureau of Criminal Identification and
Information.
Present law provides that the bureau shall make available to the following entities any
information contained in the criminal history record and identification files of the bureau:
any eligible criminal justice agency; DHH; the state fire marshal; DSS; the Dept. of
Insurance; the La. State Racing Commission; the Senate and Governmental Affairs
Committee; the executive director of the La. Workforce Commission or his designee; the
Board of River Port Pilot Commissioners; the Office of Financial Institutions; the office of
the disciplinary counsel of the La. Attorney Disciplinary Board of the La. State Bar
Association; the municipal or parish department or personnel responsible for reviewing
applications for alcoholic beverage outlet permits; and the legislative auditor. 
Proposed law adds the La. Real Estate Commission to the list of present law entities that
have access to all criminal history information maintained by the La. Bureau of Criminal
Identification and Information.
Effective upon signature of governor or lapse of time of time for gubernatorial action.
