DISTRICTS/CRIME PREVENT: Provides relative to the Lakewood Crime Prevention and
Improvement District
AN ACT1
To amend and reenact R.S. 33:9091.8(F)(2) and (4)(c), relative to the Lakewood Crime2
Prevention and Improvement District; to authorize the district to expand the levy of3
the parcel fee; to provide for an election on the question of expanding the parcel fee;4
to authorize the renewal of the parcel fee at any election; and to provide for related5
matters.6
Notice of intention to introduce this Act has been published7
as provided by Article III, Section 13 of the Constitution of8
Louisiana.9
Be it enacted by the Legislature of Louisiana:10
Section 1. R.S. 33:9091.8(F)(2) and (4)(c) are hereby amended and reenacted to read11
as follows:12

(2)(a) For purposes of this Section, a parcel is defined as a lot or lots upon17
which only one main house is situated. The fee shall be a flat fee and shall be18

as determined by duly adopted resolution of the board and shall not exceed four1
hundred fifty dollars per parcel per year.2
(b) Notwithstanding the provisions of Subparagraph (a) of this Paragraph,3
the fee imposed pursuant to this Subsection shall also be levied on any parcel within4
the district upon which there is no structure, as provided by duly adopted resolution5
of the board of commissioners of the district and if approved by a majority of the6
registered voters of the district voting on a proposition authorizing the fee at an7
election held for that purpose in accordance with the Louisiana Election Code; such8
election shall be held only if requested by duly adopted resolution of the board of9
commissioners of the district. If imposition of the fee on parcels is authorized as10
provided in this Subparagraph, it shall be imposed in the same amount and for the11
same duration as the fee on lots upon which houses are situated as otherwise12
authorized by this Paragraph.13

(c) The fee shall expire on December thirty-first after the 2010 mayoral17
election for the city of New Orleans, but the fee may be renewed or the maximum18
amount of the fee provided in Paragraph (2) of this Subsection may be changed if19
approved by a majority of the registered voters of the district voting on the20
proposition at an election as provided in Subparagraph (a) of this Paragraph.  Any21
election to authorize renewal of the fee or change of the maximum fee amount shall22
be held only at the same time as the mayoral primary election for the city of New23
Orleans. If the fee is renewed or the maximum amount thereof changed, the term of24
the imposition of the fee shall be as provided in the proposition authorizing such25
renewal or change, not to exceed eight years.26

Section 2. This Act shall become effective upon signature by the governor or, if not28

by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If1
vetoed by the governor and subsequently approved by the legislature, this Act shall become2
effective on the day following such approval.3

Abstract: Authorizes the Lakewood Crime Prevention and Improvement District in Orleans
Parish to levy a parcel fee on vacant parcels within the district and to renew the
parcel fee at any election.
Present law creates the Lakewood Crime Prevention and Improvement District in Orleans
Parish.  Present law provides for the boundaries, governance, purpose, and duties of the
district. Further authorizes the district to levy a parcel fee not to exceed $450, subject to
voter approval.  Proposed law retains present law.
Present law authorizes the district to levy the parcel fee on lots within the district upon which
one main house is situated.  Proposed law authorizes the district to expand the parcel fee to
include vacant lots.  Proposed law requires voter approval before the fee may be levied on
undeveloped parcels.
Present law authorizes voters to renew the parcel fee.  Proposed law retains present law.
Present law allows the voters to renew the parcel fee at any mayoral primary election in the
city of New Orleans.  Proposed law changes this requirement; authorizes the renewal of the
parcel fee at any regularly scheduled election.
Effective upon signature of governor or lapse of time for gubernatorial action.
