AN ACT1
To amend and reenact R.S. 33:9091.8(F)(1), (2), and (4)(c), relative to the Lakewood Crime2
Prevention and Improvement District; to authorize the district to expand the levy of3
the parcel fee; to provide for an election on the question of expanding the parcel fee;4
to authorize the renewal of the parcel fee at any election; and to provide for related5
matters.6
Notice of intention to introduce this Act has been published7
as provided by Article III, Section 13 of the Constitution of8
Louisiana.9
Be it enacted by the Legislature of Louisiana:10
Section 1.  R.S. 33:9091.8(F)(1), (2), and (4)(c) are hereby amended and reenacted11
to read as follows:12

F. Parcel fee. (1)  The governing authority of the city of New Orleans is15
hereby authorized to impose and collect a parcel fee within the district subject to and16
in accordance with the provisions of this Subsection. For purposes of this Section,17
a parcel is defined as a lot or lots upon which only one main house is situated.18
(2)(a) For purposes of this Section, a parcel is defined as a lot or lots upon19
which only one main house is situated.  The fee shall be a flat fee and shall be20
imposed on each parcel located within the district. The amount of the fee shall be21
as determined by duly adopted resolution of the board and shall not exceed four22
hundred fifty dollars per parcel per year.23 ENROLLEDHB NO. 521

(b) Notwithstanding the provisions of Subparagraph (a) of this Paragraph,1
the fee imposed pursuant to this Subsection shall also be levied on any parcel within2
the district upon which there is no structure, as provided by duly adopted resolution3
of the board of commissioners of the district and if approved by a majority of the4
registered voters of the district voting on a proposition authorizing the fee at an5
election held for that purpose in accordance with the Louisiana Election Code. Such6
election shall be held only if requested by duly adopted resolution of the board of7
commissioners of the district. If imposition of the fee on parcels is authorized as8
provided in this Subparagraph, it shall be imposed in the same amount and for the9
same duration as the fee on lots upon which houses are situated as otherwise10
authorized by this Paragraph.11

(c) The fee shall expire on December thirty-first after the 2010 mayoral15
election for the city of New Orleans, but the fee may be renewed or the maximum16
amount of the fee provided in Paragraph (2) of this Subsection may be changed if17
approved by a majority of the registered voters of the district voting on the18
proposition at an election as provided in Subparagraph (a) of this Paragraph.  Any19
election to authorize renewal of the fee or change of the maximum fee amount shall20
be held only at the same time as the mayoral primary election for the city of New21
Orleans. for that purpose in accordance with the Louisiana Election Code. If the fee22
is renewed or the maximum amount thereof changed, the term of the imposition of23
the fee shall be as provided in the proposition authorizing such renewal or change,24
not to exceed eight years.25

Section 2. This Act shall become effective upon signature by the governor or, if not27
signed by the governor, upon expiration of the time for bills to become law without signature28

vetoed by the governor and subsequently approved by the legislature, this Act shall become1
effective on the day following such approval.2
