ACT No. 381 Regular Session, 2010 HOUSE BILL NO. 525 BY REPRESENTATIVE FANNIN AN ACT1 To enact R.S. 47:299.21, relative to offset claims against individual income tax refunds; to2 require the Department of Public Safety and Corrections and the Board of Parole to3 file such a claim under certain circumstances; to provide for an effective date; and4 to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 47:299.21 is hereby enacted to read as follows: 7 ยง299.21. Collection of past due probation or parole fees; Department of Public8 Safety and Corrections; Board of Parole9 In addition to any other legal remedies provided by law, the Department of10 Public Safety and Corrections, division of probation and parole, hereinafter11 "department", and the Board of Parole, hereinafter "board", shall seek the collection12 of past due probation or parole fees imposed by the department or board against a13 person convicted of a criminal offense and committed to the department for a term14 of imprisonment from state tax refunds. The department and the board shall be15 required to participate in the program established within the Department of Revenue16 to offset individual income tax refunds against debts owed to state agencies. The17 department and the board shall comply with all of the requirements and rules of such18 program as provided for in R.S. 47:299.1 et seq.19 Section 2. This Act shall become effective upon signature by the governor or, if not20 signed by the governor, upon expiration of the time for bills to become law without signature21 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
