AN ACT1
To amend and reenact R.S. 33:9078(F)(4)(c), relative to the Kenilworth Improvement2
District in Orleans Parish; to provide relative to the renewal of parcel fees in the3
district; and to provide for related matters.4
Notice of intention to introduce this Act has been published5
as provided by Article III, Section 13 of the Constitution of6
Louisiana.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 33:9078(F)(4)(c) is hereby amended and reenacted to read as9
follows:10

(c) The fee shall expire on December 31, 2010, but the fee may be renewed,17
the amount of the fee provided in Paragraph (2) of this Subsection may be changed,18
or a maximum fee amount in excess of the amount of the fee provided in Paragraph19
(2) of this Subsection may be established, if approved by a majority of the registered20
voters of the district voting on the proposition at an election as provided in21
Subparagraph (a) of this Paragraph held for that purpose in accordance with the22
Louisiana Election Code.  Any election to authorize renewal of the fee, to change the23
amount of the fee, or to establish a new maximum fee amount shall be held only at24 ENROLLEDHB NO. 542

the same time as the mayoral primary election for the city of New Orleans. If the fee1
is renewed, if the amount of fee is changed with voter approval, or if a new2
maximum fee amount is established, the term of the imposition of the fee shall be as3
provided in the proposition authorizing such renewal, change in fee amount, or4
maximum fee amount, not to exceed eight years.  If a new maximum fee amount is5
established as provided in this Subparagraph, the amount of the fee shall be6
determined and such amount may be changed by duly adopted resolution of the7
board without the necessity of an election, provided that the fee amount shall not8
exceed the maximum fee amount and the term of imposition shall not exceed the9
term of imposition established with voter approval.10

Section 2. This Act shall become effective upon signature by the governor or, if not12
signed by the governor, upon expiration of the time for bills to become law without signature13
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If14
vetoed by the governor and subsequently approved by the legislature, this Act shall become15
effective on the day following such approval.16
