ELDERLY: Aurthorizes banks or their affiliates to report suspected crimes to certain
agencies
AN ACT1
To enact R.S. 6:333(A)(13) and (F)(17), relative to adult protective services; to provide for2
a definition; to authorize banks and their affiliates to report certain suspected crimes3
to enforcement agencies; and to provide for relative matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 6:333(A)(13) and (F)(17) are hereby enacted to read as follows:6
ยง333.  Disclosure of financial records; reimbursement of costs7
A.  As used in this Section:8

(13)  "Adult protective agency" means any of the following:10
(a)  The office of elderly affairs within the office of the governor.11
(b)  The office of aging and adult services within the Department of Health12
and Hospitals.13

F. The following disclosures by a bank or any affiliate are hereby15
specifically authorized and, except as otherwise provided in this Subsection, nothing16
in this Section shall prohibit, restrict, or otherwise apply to:17

(17) The disclosure by a bank or any affiliate of information related to any19

abuse, exploitation, or financial crime, to any local or state law enforcement agency1
or adult protective agency.  Such a disclosure of information to law enforcement2
agencies or adult protective agencies shall be limited to the name of the customer,3
the account involved, and the nature of the suspected abuse, exploitation, or financial4
crime against the customer.5

law enforcement agencies or adult protective agencies.
Proposed law provides for a definition of "adult protective agency".
Proposed law authorizes the disclosure by a bank or any affiliate of information related to
any suspected crime against a bank customer, including but not limited to any suspected
abuse, exploitation, or financial crime, to any local or state law enforcement agency or adult
protective agency.  Such a disclosure of information to law enforcement agencies or adult
protective agencies shall be limited to the name of the customer, the account involved, and
the nature of the suspected abuse, exploitation, or financial crime against the customer
