Regular Session, 2010 HOUSE BILL NO. 610 BY REPRESENTATIVE KATZ PUBLIC RECORDS: Extends public records exemption to all practitioners licensed by the La. State Board of Medical Examiners AN ACT1 To amend and reenact R.S. 44:4(7), relative to the Louisiana State Board of Medical2 Examiners; to provide for an exemption from public records requirements for those3 health professions regulated by the Louisiana State Board of Medical Examiners; to4 provide that public records law does not apply to certain documents concerning the5 fitness of health professionals to hold licenses, permits, certificates, or registration;6 and to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 44:4(7) is hereby amended and reenacted to read as follows: 9 ยง4. Present law provides that public records law does not apply to any records, writings, accounts, letters, letter books, photographs, copies, memoranda, and any report or reports concerning the fitness of any person to receive, or continue to hold, a license to practice medicine or midwifery in the custody or control of the La. State Board of Medical Examiners. Proposed law retains present law and adds email and data to the type of documents that are not public records for these purposes. Proposed law also adds that this public records exemption extends to any health profession that is regulated by the La. State Board of Medical Examiners. (Amends R.S. 44:4(7))
