Regular Session, 2010 HOUSE BILL NO. 622 BY REPRESENTATIVE HOFFMANN MILITARY AFFAIRS: Provides relative to professional fees and continuing education requirements AN ACT1 To amend and reenact R.S. 37:1681, relative to the armed forces of the United States and the2 Louisiana National Guard; to provide with respect to professional fees; to provide3 with respect to continuing education requirements for professions; to provide for4 exceptions for members of the military; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 37:1681 is hereby amended and reenacted to read as follows: 7 ยง1681. Armed forces, professional persons in; remittance of annual fees; continuing8 education requirements9 A. The annual or renewal fee that would be due by a member of any10 profession to any state board, commission, department, or agency for such member11 to continue to be entitled to practice his profession in this state is remitted in favor12 of such member while he is enlisted and serving in any of the armed forces of the13 United States, or has been mobilized or called to active duty in his capacity as a14 member of the Louisiana National Guard. The remission of the annual or renewal15 fee shall not apply to any annual or renewal fee that was delinquent at the time of16 enlistment in the service, but shall include annual or renewal fees that fall due for17 two calendar years following the year in which the member receives his honorable18 discharge, or his mobilization or activation with the Louisiana National Guard has19 ended.20 HLS 10RS-282 ORIGINAL HB NO. 622 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. B. Any member of the armed forces of the United States or the Louisiana1 National Guard who is mobilized or called to active duty shall be exempted from all2 continuing education requirements imposed by the state board, commission,3 department, or agency authorized to issue and maintain a permit, license or4 certification under this Title for his respective profession during the duration of his5 activation or mobilization. The exemption of continuing education requirements6 shall not include continuing education requirements that were delinquent at the time7 of enlistment in the service or activation or mobilization of the Louisiana National8 Guard. The member of the armed forces of the United States or the Louisiana9 National Guard shall resume his status as a member of his profession in good10 standing when he receives his honorable discharge or his activation or mobilization11 with the Louisiana National Guard has ended.12 DIGEST The digest printed below was prepared by House Legislative Services. National Guard. Present law provides that members of the armed forces shall not be assessed any annual or renewal fee due by a member of any profession while he is enlisted and serving in any of the armed forces of the United States. Proposed law retains present law and extends it to members of the Louisiana National Guard who have been activated. Proposed law further provides that members of the U.S. armed forces, and activated members of the Louisiana National Guard shall not be responsible for continuing education requirements for their professions while activated.
