INSURANCE/HOMEOWNERS:  Prohibits the cancellation, nonrenewal, or increase in
premium of an insured's homeowner's insurance policy based on the presence of
Chinese drywall or a claim related to Chinese drywall
AN ACT1
To enact R.S. 22:1338, relative to homeowner's insurance; to provide for the prohibition2
against the cancellation, nonrenewal, or increase in policy premium based on the3
presence of or a claim related to Chinese drywall; to allow the cancellation,4
nonrenewal, or increase in policy premium on an area-wide basis at the beginning5
of a new policy period; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 22:1338 is hereby enacted to read as follows: 8
ยง1338.  Homeowner's insurance; Chinese drywall9
No insurer shall cancel or fail to renew a homeowner's policy of insurance,10
or increase the amount of premium associated with that policy, on the grounds that11
the insured dwelling contains Chinese drywall or that the insured has submitted a12
claim under his policy for damages incurred or arising from the presence of Chinese13
drywall, except if such cancellation, nonrenewal, or increase in premium is14
implemented on an area-wide rating basis at the beginning of a new policy period.15
For the purposes of this Section, Chinese drywall shall mean any drywall imported16
from or manufactured in China from 2004 to 2008 or drywall that contains elevated17

Abstract: Prohibits the cancellation, nonrenewal, or increase in premium of homeowner's
insurance based on the presence of or claim related to Chinese drywall.
Proposed law prohibits the cancellation, nonrenewal, or increase in premium on the grounds
that the insured dwelling contains Chinese drywall or that the insured has submitted a claim
based on damages incurred or arising from the presence of Chinese drywall; however,
proposed law allows the cancellation, nonrenewal, or increase in premium on an area-wide
basis at the beginning of a new policy period.  
Proposed law defines "Chinese drywall" as any drywall imported from or manufactured in
China from 2004 to 2008 or any drywall containing elevated levels of sulphur or strontium.
